Where preservation is feasible but the applicant still seeks demolition, the city may take <br />any of the actions authorized by section 15.2-2306 A.4 of the Code of Virginia. <br /> <br />(c) A decision by the Committee concerning a certificate of appropriateness for the <br />demolition of historic structures, sites, or objects shall be guided by: <br /> <br />(I) The historic, scenic, cultural, aesthetic or architectural significance of the <br />building, structure, site, or object. <br /> <br />(2) The importance of the historic structure, site, or object to the ambiance of a <br />district. <br /> <br />(3) The difficulty or the impossibility of reproducing such a building, structure, site, <br />or object because of its design, texture, material, detail, or unique location. <br /> <br />(4) Whether the historic structure, site, or object is one of the last remaining examples <br />of its kind in the neighborhood or the city. <br /> <br />(5) Whether there are definite plans for reuse of the property if the proposed <br />demolition is carried out, and what the effect of those plans on the character of the surrounding <br />area would be. <br /> <br />(6) Whether reasonable measures can be taken to save the historic structure, site, or <br />object from collapse. <br /> <br />(7) Whether the historic structure, site, or object is capable of earning reasonable <br />economic return on its value. <br /> <br />Sec. 40-57.1.10. Certificate of Appropriateness; relocation of historic structure or object. <br /> <br />A decision by the Downtown Design Committee concerning a certificate of <br />appropriateness for the relocation of a historic structure, or object shall be guided by: <br /> <br />(a) The historic, scenic, cultural, aesthetic or architectural significance of the <br />building, structure, site, or object. <br /> <br />(b) The importance of the historic structure, site, or object to the ambiance of a <br />district. <br /> <br />(c) Whether there are definite plans for the property to be vacated and what the effect <br />of those plans on the character of the surrounding area will be. <br /> <br />(d) Whether the historic structure or object can be moved without significant damage <br />to its physical integrity. <br /> <br />(e) Whether the proposed relocation area is compatible with the scenic, cultural, <br />aesthetic, historical, and architectural character of the building, structure, site, or object. <br /> <br />Sec. 40-58. Certificate of Appropriateness; enforcement and remedies. <br /> <br />(a) Any violation or attempted violation of this article or of any condition or <br />requirement adopted pursuant hereto may be restrained, corrected or abated by injunction or <br />other appropriate proceeding pursuant to the Code of Virginia. <br />
