<br /> <br />2~115 <br />.~~~ <br /> <br />AN ORDINANCE (1) TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY REPEALING AND RESERVING DIVISION 2 <br />OF ARTICLE IV, BY ADDING A NEW DIVISION 3 AND A NEW TABLE 40-56.1 TO <br />SAID ARTICLE, BY REPEALING CURRENT SECTIONS 40-179 AND 40-179.1 AND <br />ADOPTING NEW SECTIONS 40-179 AND 40-179.1, BY AMENDING SECTIONS 40- <br />50.15,40-60.8,40-65.3,40-65.8,40-71.2, and 40-171.1, BY AMENDING TABLES 40-43.1.3, <br />40-44-3, AND 40-44-4 TO REMOVE ALL REFERENCES, LIMITATIONS, AND <br />REQUIREMENTS PERTAINING TO THE DOWNTOWN D-l AND D-2 ZONING <br />DISTRICTS; (2) TO AMEND CHAPTER 32 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 32-7(d) THEREOF <br />PERTAINING TO STREET ENCROACHMENTS, AND (3) TO AMEND CHAPTER 36 <br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING <br />TABLE 36.1 THEREOF. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Division 2 of Article IV of Chapter 40 of the Code of the City of <br />Portsmouth, Virginia (2006) be repealed and reserved. <br /> <br />2. That a new Division 3 entitled "DOWNTOWN DISTRICTS," containing new <br />Sections 40-55 through 40-59.1, is adopted and added to Article IV of Chapter 40 ofthe Code of <br />the City of Portsmouth, Virginia to read as follows: <br /> <br />DIVISION 2. DOWNTOWN DISTRICTS <br /> <br />Sec. 40-55. Specific purpose of Downtown Districts. <br /> <br />The Downtown Districts, consisting of the Downtown D-I and D-2 Districts, are created <br />for the purposes set forth in section 40-51 and also, without limitation, for the promotion and <br />preservation of the city's educational, cultural and economic interests, opportunities and <br />advantages. Such districts include and bound the only significant tourist routes providing access <br />to the many historic structures and buildings in downtown Portsmouth and to its historic <br />waterfront and governmental center and contain many significant historic structures and <br />buildings. <br /> <br />The Downtown Districts fulfill this purpose through: <br /> <br />( a) The preservation and protection of buildings, structures, places and areas of <br />educational, cultural, economic and civic interest in the core area of the original community <br />settlement; <br /> <br />(b) The development and maintenance of appropriate settings and environment for <br />such buildings, structures, places and areas; <br /> <br />(c) The protection and enhancement of the tourist corridors leading to the historic <br />core area, governmental center and historic waterfront; <br /> <br />(d) The regulation and control of construction of new buildings and structures in <br />accordance with the City's Comprehensive Plan, the Downtown Master Plan and Waterfront <br />Strategy, and Downtown Design Manual, adopted by the city council to protect such areas and <br />the setting and environment found, preserved and promoted therein. <br />
