<br />ORDI <br /> <br /> <br />E 1O~~9-:1.~i <br /> <br />AN ORDINANCE TO AMEND CHAPTER 38 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006), BY AMENDING SECTION 38-366 THEREOF <br />PERT AINING TO GUNS ON CITY LAKES AND LAKE PROPERTY. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the Code of the City of Portsmouth, Virginia (2006) be, and hereby is, <br />amended and reordained by amending subsections (e) and (f) of Section 38-366, as follows: <br /> <br />Sec. 38-366. Regulations applicable to city owned land adjoining city lakes and shores. <br /> <br />(a) No person shall go on any city-owned land adjoining any city-owned property <br />outside of posted hours unless he is a warden, law enforcement officer, member of a rescue unit, <br />or other authorized personnel. <br /> <br />(b) No person shall bring, possess, or drink any alcoholic beverage or possess or be <br />under the influence of any drug or intoxicant of any kind while on the city lakes or on any city- <br />owned land adjoining any city lake. <br /> <br />(c) No person shall camp, hike, bicycle, motorcycle, or use all terrain vehicles or any <br />type of recreational vehicle on city-owned watershed property without the prior written <br />permission of the Director of Public Utilities. <br /> <br />(d) No person shall kindle, build, maintain or use a fire on city-owned property except <br />in grills and fireplaces located in areas designated by the Director of Public Utilities. <br /> <br />(e) No person shall carry or possess any BB or pellet gun or paint-ball gun on a city <br />lake unless expressly authorized by the director of public utilities in writing, unless such person <br />is a state, local or federal law enforcement officer or game warden acting in the performance of <br />their official duties. <br /> <br />(f) No person shall willfully throw or discharge or cause to be discharged any arrow, <br />stone, missile or other projectile by hand or from a bow, crossbow, slingshot or by any other <br />comparable device on any city lake or city-owned land adjoining any city lake. <br /> <br />(g) Automobiles and trucks are allowed on city-owned watershed property only to <br />launch and retrieve boats at designated city-owned boat ramps except for those automobiles and <br />trucks used by law enforcement officers, game wardens, forest wardens and city employees in the <br />performance of their duties. <br /> <br />(h) No person shall use city-owned watershed property for storage of any sort or for <br />unauthorized vehicular parking. <br /> <br />(i) No person shall cause any loud, disturbing or unnecessary noise through the use of <br />any sound amplification equipment, radio or other means on any city lake or on any city-owned <br />
