'. .1l2009;-J.OQ ORDINANCE TO CLOSE A PORTION OF COLUMBIA STREET FROM WEST OF THE WESTERN BOUNDARY OF WILLIAMSBURG AVENUE TO ITS TERMINUS. WHEREAS, Oasis: Commission on Social Ministry of Portsmouth-Chesapeake has requested the closure of a portion of Columbia Street from west of the western boundary of Williamsburg A venue to the terminus of Columbia Street, as hereafter described; and WHEREAS, the Planning Commission, at a meeting held on September 1,2009, recommended approval of the closure and vacation of Columbia Street from west of the western boundary of Williamsburg A venue to the terminus of Columbia Street, as hereafter described; and WHEREAS, notice ofthe proposed closure and vacation has been given the adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. NOW, THEREFORE, BE IT ORDAINED by the Council ofthe City of Portsmouth, Virginia that a portion of Columbia Street from west of the western boundary of Williamsburg Avenue to the terminus of Columbia Street as hereafter described be closed and vacated as a public street and right of way in the City of Portsmouth, Virginia, as follows: All that portion of Columbia Street shown on the attached Exhibit; BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an easement in the portion of Columbia Street hereby closed and vacated for the installation, operation, maintenance and replacement of public utilities, which said easement may be released and vacated by the City Manager of the City of Portsmouth as he may in his discretion deem appropriate and in the best interest of the City of Portsmouth. BE IT FURTHER ORDAINED, that the City Manager is hereby authorized to execute such deeds or other documents as he may deem appropriate and necessary to convey such rights as the City may have in said closed portion of Columbia street as may be required by the adjoining property owners, including without limitation: (a) a Deed of Quitclaim conveying all of the City's right, title and interest in and to the western area of the closure to Robert D. Anderson, subject to the reservation of an easement for the construction, installation, and maintenance of storm water drainage facilities, all as shown on the attached Exhibit; and (b) a Deed of Quit Claim conveying all of the City's right, title and interest in and to the remainder of the area of the closure to Oasis: Commission on Social Ministry of Portsmouth- Chesapeake.
