<br />ORDINANCE NO~ 2.0081~~?_ <br /> <br />AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 2-114(t) <br />THEREOF, PERTAINING TO POLITICAL ACTIVITIES OF CITY <br />EMPLOYEES. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That section 2-ll4(t) of the Code ofthe City of Portsmouth, Virginia <br />(2006) be amended and reordained to read as follows: <br /> <br />Sec. 2-114. Political activities restricted. <br /> <br />(a) Application of section. The provisions of this section shall apply to all pay <br />and classification plan employees of the city, the city manager and all department heads <br />and employees appointed by him, officers appointed by the city council, and all staff <br />assistants in those departments (including the city clerk, city attorney, and real estate <br />assessor). The provisions of this section shall not apply to members of boards and <br />commissions who are not pay and classification plan employees of the city nor to <br />members of the city council. <br /> <br />(t) Holding elected office while employed by city prohibited. No person to whom <br />this section applies may continue to serve as a city employee if the person is elected or <br />appointed to, and thereafter assumes office, in any of the following elected positions: <br />Mayor, Member of Portsmouth City Council, Sheriff, Commonwealth's Attorney, <br />Treasurer, Commissioner of Revenue, Clerk of Circuit Court, Member of the Senate of <br />Virginia, or Member of the Virginia House of Delegates. Upon assuming any such <br />office, the person's employment shall be deemed terminated by action oflaw, unless the <br />person has previously resigned. <br /> <br />2. That this ordinance shall take effect on the date of its adoption. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on April 8, 2008. <br /> <br />Teste: <br /> <br />City Clerk <br />
