ORDINANCE NO~ 2.0081~~?_ AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 2-114(t) THEREOF, PERTAINING TO POLITICAL ACTIVITIES OF CITY EMPLOYEES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That section 2-ll4(t) of the Code ofthe City of Portsmouth, Virginia (2006) be amended and reordained to read as follows: Sec. 2-114. Political activities restricted. (a) Application of section. The provisions of this section shall apply to all pay and classification plan employees of the city, the city manager and all department heads and employees appointed by him, officers appointed by the city council, and all staff assistants in those departments (including the city clerk, city attorney, and real estate assessor). The provisions of this section shall not apply to members of boards and commissions who are not pay and classification plan employees of the city nor to members of the city council. (t) Holding elected office while employed by city prohibited. No person to whom this section applies may continue to serve as a city employee if the person is elected or appointed to, and thereafter assumes office, in any of the following elected positions: Mayor, Member of Portsmouth City Council, Sheriff, Commonwealth's Attorney, Treasurer, Commissioner of Revenue, Clerk of Circuit Court, Member of the Senate of Virginia, or Member of the Virginia House of Delegates. Upon assuming any such office, the person's employment shall be deemed terminated by action oflaw, unless the person has previously resigned. 2. That this ordinance shall take effect on the date of its adoption. ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on April 8, 2008. Teste: City Clerk
