<br />ORDINANCE NO. 2008=-:.:. <br /> <br />AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY DELETING THE WATERFRONT W-l <br />REGULATIONS IN TABLE 40-43.1-2 THEREOF, BY AMENDING THE <br />WATERFRONT W-l REGULATIONS CONTAINED IN TABLES 40-44-3 AND <br />40-44-4, AND BY ADOPTING A NEW ARTICLE III, DIVISION 6 PERTAINING <br />TO THE WATERFRONT W-l ZONING DISTRICT. <br /> <br />BE IT ORDAINED by the Council ofthe City of Portsmouth, Virginia: <br /> <br />1. That Table 40-43.1-2 of the Code of the City of Portsmouth, Virginia <br />(2006) be amended by deleting the column entitled W -I therefrom. <br /> <br />2. That Table 40-44-3 of the Code of the City of Portsmouth, Virginia (2006) <br />be amended by deleting the Minimum Lot Size and Maximum Building Coverage (%) <br />requirements in the W -I Waterfront zoning district, and by making Maximum Building <br />Coverage (%) and Maximum Building Height (ft) subject to a new Note "c" adopted <br />hereby and reading as follows: <br /> <br />c= This dimensional requirement shall be as determined by the design guidelines <br />approved for an applicant for a rezoning application in the W-l zoning district. <br /> <br />3. That Table 40-44-4 of the Code of the City of Portsmouth, Virginia (2006) <br />be amended by deleting all of the yard requirements as to the W -1 Waterfront zoning <br />district. <br /> <br />4. That Chapter 40 of the Code of the City of Portsmouth, Virginia (2006) be <br />amended by adopting a new Article III, Division 6 to read as follows: <br /> <br />Article III. Zoning Districts <br /> <br />Division 6. Waterfront W-l District <br /> <br />Sec. 40-50.10. Waterfront W-l district. <br /> <br />The purpose of a W -I district shall be to promote the following: <br /> <br />(1) Primary goals. Creation of a high quality, mixed use residential, retail, <br />office and/or hotel development enhanced by its close proximity to the Elizabeth River <br />waterfront; facilitation of economic development benefits that will accrue through <br />enhanced commercial and residential development and increased tourism generated by <br />riverfront development; and promotion of a concentration of uses that result in a high <br />degree of pedestrian attraction and activity along the waterfront, while protecting the area <br />at the shore of the river from building development. <br />(2) Flexible approach to design. Availability of development requirements <br />adaptable to changing market conditions and encouragement of creativity in the design of <br />new mixed development centers. <br />
