ORDINANCE NO. 2008=-:.:. AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) BY DELETING THE WATERFRONT W-l REGULATIONS IN TABLE 40-43.1-2 THEREOF, BY AMENDING THE WATERFRONT W-l REGULATIONS CONTAINED IN TABLES 40-44-3 AND 40-44-4, AND BY ADOPTING A NEW ARTICLE III, DIVISION 6 PERTAINING TO THE WATERFRONT W-l ZONING DISTRICT. BE IT ORDAINED by the Council ofthe City of Portsmouth, Virginia: 1. That Table 40-43.1-2 of the Code of the City of Portsmouth, Virginia (2006) be amended by deleting the column entitled W -I therefrom. 2. That Table 40-44-3 of the Code of the City of Portsmouth, Virginia (2006) be amended by deleting the Minimum Lot Size and Maximum Building Coverage (%) requirements in the W -I Waterfront zoning district, and by making Maximum Building Coverage (%) and Maximum Building Height (ft) subject to a new Note "c" adopted hereby and reading as follows: c= This dimensional requirement shall be as determined by the design guidelines approved for an applicant for a rezoning application in the W-l zoning district. 3. That Table 40-44-4 of the Code of the City of Portsmouth, Virginia (2006) be amended by deleting all of the yard requirements as to the W -1 Waterfront zoning district. 4. That Chapter 40 of the Code of the City of Portsmouth, Virginia (2006) be amended by adopting a new Article III, Division 6 to read as follows: Article III. Zoning Districts Division 6. Waterfront W-l District Sec. 40-50.10. Waterfront W-l district. The purpose of a W -I district shall be to promote the following: (1) Primary goals. Creation of a high quality, mixed use residential, retail, office and/or hotel development enhanced by its close proximity to the Elizabeth River waterfront; facilitation of economic development benefits that will accrue through enhanced commercial and residential development and increased tourism generated by riverfront development; and promotion of a concentration of uses that result in a high degree of pedestrian attraction and activity along the waterfront, while protecting the area at the shore of the river from building development. (2) Flexible approach to design. Availability of development requirements adaptable to changing market conditions and encouragement of creativity in the design of new mixed development centers.
