<br />URot <br /> <br /> <br />1W~2~1 <br /> <br />AN ORDINANCE CLOSING AND VACATING A PORTION OF BART STREET. <br /> <br />WHEREAS, Marilyn Mackiewicz and 1. R. Lilienthal, Sr. requested the closure of a <br />portion of Bart Street as hereafter described; and <br /> <br />WHEREAS, the Planning Commission at a meeting held on October 7, 2008, <br />recommended approval of the closure and vacation of a portion of Bart Street; and <br /> <br />WHEREAS, notice of the proposed closure and vacation has been given the adjoining <br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that a portion of Bart Street be closed and vacated as a public street and right of way as <br />follows: <br /> <br />BART STREET <br /> <br />All that portion of Bart Street shown and designated as "DENOTES PORTION OF <br />BART STREET TO BE CLOSED AND VACATED, AREA = 7500 SQ. FT." as shown on that <br />certain Exhibit entitled "EXHIBIT SH()WING PORTION OF BART STREET TO BE <br />CLOSED AND VACATED, PORTSMOUTH, VIRGINIA dated October 24, 2008, prepared by <br />the City of Portsmouth. <br /> <br />BE IT FURTHER ORDAINED, that the City of Portsmouth hereby reserves an area <br />designated as "AREA RESERVED FOR CUL-DE-SAC PURP()SES (4,130 +\- SQ. FT.)" as set <br />forth and designated on the aforementioned Exhibit. <br /> <br />BE IT FURTHER ORDAINED that the City Manager is hereby authorized to convey <br />the City's interest in said closed and vacated street to the adjoining landowners in conformance <br />with the terms of their written agreement. This Ordinance shall not take effect until the <br />adjoining landowners have provided the City with a written agreement as to how the street is to <br />be divided. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on <br />November 10, 2008. <br /> <br />Teste: <br /> <br />City Clerk <br />
