That the property located at 5801 Portsmouth Boulevard was rezoned from <br />Residential RS-75 to Commercial C-I-K (Conditional) on January 14, 2003 (Z-02-12) <br />and has been subject to certain conditions of development proffered at the time of the <br />rezoning application and approval. <br /> <br />2. That the applicant has now proffered modified conditions and requested <br />that City Council modify the conditions attached to the property. <br /> <br />3. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning ()rdinance which now zones as Commercial C-I-K (Conditional) <br />the property described in Petition for Zoning Amendment Number Z-08-06, is hereby <br />amended and changed so as to show said property as subject to modified conditions as <br />contained herein. <br /> <br />4. That the property affected by the proffered modified conditions, is <br />furthermore described as follows: <br /> <br />Z-08-06 <br /> <br />(5801 Portsmouth Boulevard) <br /> <br />The parcel described as beginning at the south side of <br />Portsmouth Boulevard approximately 747.91 feet from its <br />intersection with Elmhurst Lane; thence north <br />approximately 244.77 feet to a point; thence easterly <br />approximately 241.43 feet to a point; thence southeasterly <br />approximately 38.52 feet to a point; thence south <br />approximately 241.16 feet to a point; thence west <br />approximately 225.47 feet to the point of beginning. <br /> <br />5. That the subject property shall be subject to the following modified <br />conditions as proffered by the applicant for rezoning: <br /> <br />(a) Use of property shall be limited to physical fitness centers (karate <br />instruction), eating places, general merchandise stores, finance and <br />depository institutions, insurance agents, broker services, real estate office <br />and/or SIC Classifications 15, 472, 5251, 56, 57, 59, 591, 5942, 5943, <br />5944, 5947, 5992, 63, 64, 72, 723, 724, 7291, 7299, 7389, 7997, 81, and <br />87. <br />
