<br />UROlNANCE NO~Q07-3~. <br /> <br />AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY ADOPTING A NEW SECTION 22-567.1 <br />AND BY AMENDING SECTION 22-566 THEREOF PERTAINING TO <br />RESIDENTIAL PARKING DISTRICTS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the City Council hereby adopts a new Section 22-567.1 of the Code <br />of the City of Portsmouth, Virginia (2006) to read as follows: <br /> <br />Sec. 22-567.1 Residential parking districts. <br /> <br />(a) In order to reduce or prevent congestion in public streets within areas <br />zoned for residential use, to reduce hazardous traffic conditions resulting from the use of <br />such streets for the parking of vehicles by non-residents, to protect the residents of such <br />districts from unreasonable burdens in gaining access to their residences, to promote <br />efficiency in the maintenance of streets in a clean and safe condition; to preserve the <br />safety of children and other pedestrians, to protect against danger and congestion in travel <br />and transportation, to facilitate the creation of a convenient, attractive and harmonious <br />community, to preserve the value of property in residential districts; to preserve peace, <br />good order, convenience and welfare of the inhabitants of the city, the city manager is <br />hereby authorized to designate by order, rule, or regulation the creation, expansion, or <br />reduction of such residential parking district or districts as he may deem necessary to <br />accomplish the above-stated purposes. <br /> <br />(b) Upon a written finding outlining the need for the creation, reduction, or <br />expansion of a residential parking district, the city manager shall, by order, rule, or <br />regulation create, reduce, or expand such district. The order, rule or regulation shall <br />establish the conditions governing parking in the district and may provide for the <br />issuance of parking permits to residents of the district, their guests, and to others lawfully <br />engaging in activities within the district. <br /> <br />Any permit so issued shall be of such term as the city manager or his designee <br />shall deem appropriate, but in no event shall any term be longer than one year from the <br />date of issuance. Permits may be renewed upon a showing by the applicant of continued <br />eligibility. Permits shall expire automatically upon the cessation of the conditions giving <br />rise to eligibility. <br /> <br />(c) Prior to the enforcement of any order, rule, or regulation establishing a <br />residential parking district, the city manager shall cause appropriate signs giving notice of <br />the restricted parking to be posted on the streets within the district. The signs placed in <br />the district shall be of such character as to inform readily any ordinarily observant person <br />of the existence of the rules and regulations imposing the foregoing restrictions. <br /> <br />(d) Any person who represents that he is entitled to a residential parking <br />permit when not so entitled, who fails to surrender a permit to which he is no longer <br />
