<br />(b) The residcntial building improvemcnts will be constructcd substantially in <br />accordance with the elcvations dated November 2, 2006 prepared by <br />Humphrcys and Partners Architccts. L.P. and on file in the City Planning <br />Department: <br /> <br />(c) The property will be fenced with the same style fence used in the Estates <br />at River Pointe and the Villas at River Pointe; <br /> <br />(d) Landscaping adjacent to the Estates at River Pointe and the Villas at River <br />Pointe will include a berm topped by shrubbery in accordance with <br />Portsmouth City Code landscaping requirements; <br /> <br />(e) The entrance to the Property from River Pointe Parkway will be controlled <br />by an electronically acccssed gate and a guardhouse building; <br /> <br />(I) A community clubhouse will be constructed with kitchen facilities as <br />shown on the SIA site plan, and will be available to the residents of First <br />Watch at River Pointe, the Estates at River Pointe and the Villas at River <br />Pointe through a written agreement between those homeowners' <br />associations: <br /> <br />(g) The number of units will not excecd 150; <br /> <br />(h) Units will have a minimum square footage of 1400 square fcet; <br /> <br />(i) The exterior of the buildings will consist of a minimum of 80% brick or <br />stone. No vinyl siding will be permitted; <br /> <br />(j) The common areas of the condominium development will include a <br />children's play area and walking trails as shown on the SIA site plan; <br /> <br />(k) The front entrance to the Property from River Pointe Parkway will include <br />a water feature similar to the Estatcs at Rivcr Pointc; <br /> <br />(I) Driveways will be either colorcd concrete, aggrcgate concretc or brick <br />pavers; <br /> <br />(m) Thcre will be at least four parking spaccs per unit (including garages); <br /> <br />(n) Rooting materials will be architectural grade asphalt shingles; <br /> <br />(0) Thc dcclaration uf condominium or cundominium by-laws promulgated <br />and recorded fur the Property will include a provision prohibiting less than <br />90% of the units from being owner-occupied and will prohibit overnight <br />parking anywhere except in designated ot1~street parking spaces. <br />
