<br />1. Strict compliance with the regulation will deprive the property owner of <br />all reasonable use of the property <br /> <br />2. The hardship results from application of the regulation to the property. <br /> <br />3. The hardship is one that affects the property directly <br /> <br />4. The hardship is not the result of the property owner's own actions or <br />omISSIOns. <br /> <br />5. The hardship is unique to the property and is not commonly shared by <br />other similarly situated properties. <br /> <br />value. <br /> <br />6. Any financial considerations greatly decrease or destroy the property's <br /> <br />7. The condition or situation of the property concerned is not of so general or <br />recurring a nature as to make reasonably practicable the formulation of a general <br />regulation to be adopted as an amendment to this ordinance. <br /> <br />Sec. 40-54.4 Certificate of appropriateness; action required on application. . <br /> <br />(a) Upon receipt of a complete application for a certificate of appropriateness, <br />the designated staff shall place the application on the agenda for the next regularly <br />scheduled commission meeting for which it meets the deadline pursuant to the procedures <br />manual. <br /> <br />(b) During the public hearing portion of the commission meeting the <br />commission will confer with the applicant for the certificate of appropriateness and other <br />parties that appear to voice an opinion on the project. After the public comment portion <br />of the meeting has ended, the commission members shall vote to either approve or <br />disapprove such plans and specifications based on architectural compatibility and in <br />accordance with the commission's adopted standards and guidelines. <br /> <br />(c) If the application is approved, the commission shall issue a certificate of <br />appropriateness therefor with or without conditions or with such modifications of the <br />plans and specifications as the commission deems necessary and the applicant accepts to <br />fulfill the purposes and objectives declared in section 40-51 and to require compliance <br />with the regulations and restrictions set out in this chapter and the standards and <br />guidelines as adopted by the city council. <br /> <br />(d) If issued, a certificate of appropriateness shall be valid for a period of one <br />year from date of issuance. All work approved and initiated under a certificate of <br />appropriateness shall be completed within one year of issuance. Without an extension, <br />after one year from issuance of a certificate of appropriateness, an owner shall obtain a <br />
