Structures include, but are not limited to, buildings, fences, accessory buildings, <br />sidewalks, driveways, and retaining walls. <br /> <br />2. That Sections 40-61.1, 40-71.1(a), and 40-196(e) of the Code of the City <br />of Portsmouth, Virginia (2006) be amended and reordained to read as follows: <br /> <br />Sec. 40-61.1. Sign types and districts. <br /> <br />Signs shall be permitted in the various zoning districts in accordance with tables <br />40-61.1-1 and 40-61.1-2 hereby adopted, and subject to the applicable conditions <br />indicated in the "Conditions" column for each sign type on the table. Signs labeled with a <br />"P" for a district or group of districts are permitted in the district without further city <br />approval, subject to the indicated conditions. A sign labeled with a "CC" for a district is <br />permitted in the district upon the issuance of a certificate of compliance by the zoning <br />administrator, subject to the indicated conditions. A sign labeled with a "UP" for a district <br />is conditionally permitted in the district, subject to the issuance of a use permit by the city <br />council and subject to the indicated conditions. A sign labeled with "NP" for a district is <br />not permitted in the district. Signs in downtown and historic districts require review by <br />the historic preservation commission or the downtown design committee. <br /> <br />Sec. 40-71.1. Design and dimensional requirements for parking lots. <br /> <br />In all zoning districts, except historic districts as provided in section 40-53.4, <br />where four or more off-street parking spaces are permitted or required, the following <br />design and construction standards shall apply, subject to waiver of a single dimensional <br />requirement by the city engineer, in proper cases involving public safety or demonstrable <br />hardship: <br /> <br />(a) Each parking space shall be at least nine feet wide and 18 feet long, except <br />that in parking areas containing more than ten spaces, with the agreement of the traffic <br />engineer, a maximum of 30 percent of the spaces may be for compact cars. The compact <br />car spaces shall be at least eight feet wide and 16 feet long. No part of any parking space <br />required by this section shall extend over any public way or cause an automobile parked <br />in such a space to overhang a public way; <br /> <br />Sec. 40-196. Special exceptions--Requirements. <br /> <br />The board of zoning appeals may grant special exceptions in accordance with the <br />following standards, providing that the board finds that such special exception will not <br />adversely affect neighboring properties and will not be contrary to the purposes of this <br />chapter: <br /> <br />(e) Historic districts. The board is empowered to grant special exceptions for <br />the expansion of nonconforming uses in historic districts meeting the conditions stated in <br />section 40-56. <br />
