ORDIMANCE 10.2007-79_ AN ORDINANCE CLOSING AND VACATING WESTMINSTER DRIVE, LESTER COURT, ABBEY COURT (AKA LOUDON COURT) AND A PORTION OF TURNPIKE ROAD ON TAX MAP 333, PARCEL 1). WHEREAS, the City of Portsmouth has requested the closure of Westminster Drive, Lester Court, Abbey Court (aka Loudon Court) and a portion of Turnpike Road on Tax Map 333, Parcel I) as hereafter described; and WHEREAS, the Planning Commission, at a meeting held on July 3,2007, recommended approval of the closure and vacation of Westminster Drive, Lester Court, Abbey Court (aka Loudon Court) and a portion of Turnpike Road on Tax Map 333, Parcell) : and WHEREAS, notice of the proposed closure and vacation has been given the adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia that Westminster Drive, Lester Court, Abbey Court (aka Loudon Court) and a portion of Turnpike Road on Tax Map 333, Parcell) be closed and vacated as a public street and right of way as shown on the attached exhibit entitled "EXHIBIT SHOWING WESTMINSTER DRIVE, LESTER COURT, ABBEY COURT, AND A PORTION OF TURNPIKE ROAD TO BE CLOSED AND VACATED PORTSMOUTH, VIRGINIA FOR CHASE VIEW LIMITED PARTNERSHIP" DA TED May 3, 2007, revised May 8, 2007, prepared by Rouse-Sirine Associates, Ltd., Surveyors and Mapping Consultants. BE IT FURTHER ORDAINED that the City Manager is hereby authorized to convey any and all interest in said Westminster Drive, Lester Court, Abbey Court (aka Loudon Court) and a portion of Turnpike Road on Tax Map 333, Parcel I) as may have vested in the City of Portsmouth by virtue ofthis vacation and closure and any drainage facilities located therein to the owner(s) of property lying adjacent thereto. Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on August 14,2007. Teste: City Clerk
