<br />ORDINAIU .200~ <br /> <br />AN ORDINANCE TO AMEND CHAPTER 12 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY ADOPTING A NEW SECTION 12-18 <br />ESTABLISHING PENALTIES AND INTEREST ON DELINQUENT <br />ACCOUNTS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That a new Section 12-18 to the Code of the City of Portsmouth, Virginia <br />(2006) is adopted to read as follows: <br /> <br />Sec. 12-18, Delinquencies; penalty and interest imposed. <br /> <br />(a) Except as otherwise provided in this Code or by contract or agreement, in <br />the event any payment on delinquent accounts due the city is not made when due, there <br />shall be added thereto a penalty of 10% of the amount of the unpaid payment due or <br />$10.00, whichever is greater, but the penalty shall not exceed the amount of the unpaid <br />payment due. <br /> <br />(b) Except as otherwise provided in this Code or by contract or agreement, <br />any person failing to pay any sum of money due the city by the date due shall incur, in <br />addition to a penalty thereon, interest on that sum plus interest on any penalty assessed. <br />Interest at a rate of 10% per annum from the first day following the day such sum is due <br />and said penalty is assessed shall be collected upon the principal and penalties of all such <br />amounts due but remaining unpaid, and shall continue to accrue and be due until such <br />sums are paid in full. <br /> <br />(c) Any provision ofthis Code notwithstanding, there is hereby imposed upon <br />each person chargeable with a delinquent account, fees to cover the administrative costs <br />and reasonable attorney's or collection agency's fees actually contracted for. The <br />attorney's or collection fees shall not exceed 20% of the delinquent sum so collected. <br />The administrative costs shall be in addition to all other penalties and interest, and shall <br />be as set forth in Appendix A to this Code for taxes or other charges collected subsequent <br />to 30 or more days after notice of delinquency but prior to the taking of judgment with <br />respect to such delinquent account, and as set forth in appendix A to this Code for taxes <br />or other charges collected subsequent to judgment. <br /> <br />(2) That this ordinance shall take effect on July 1,2007. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on June 26, 2007, <br /> <br />Teste: <br /> <br />City Clerk <br />
