<br />(c) A subdivision site plan shall be submitted to the City <br />Engineer before construction begins. <br /> <br />(d) Backyard drainage shall be piped so that it does not run <br />into a neighbor's yard. No drainage shall run onto adjacent <br />properties. <br /> <br />(e) The Homeowners' Association documents will state that <br />the Homeowners' Association is responsible for the <br />maintenance of all landscaping and the cutting of grass in <br />the right-of-way. <br /> <br />(f) Each property will meet the City Code tree canopy <br />coverage requirements when their site plans are submitted. <br /> <br />(g) The applicant shall obtain approval from the Director of <br />General Services of a plan for the collection, storage, and <br />disposal of solid waste and garbage prior to commencement <br />of construction. <br /> <br />(h) The cul-de-sac will be constructed at least 75 feet wide. <br /> <br />(i) The applicant shall obtain a Subdivision Permit from the <br />City before construction can begin. <br /> <br />(j) The establishment shall be operated in compliance with all <br />applicable codes, ordinances, and regulations of federal, <br />state, and local governments. <br /> <br />(k) All required licenses and permits shall be obtained before <br />construction and remain in effect during the construction <br />process. <br /> <br />(1) Taxes and fees associated with the property shall be paid <br />when due. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under <br />Section 40-1 ] 5 ofthc Code of the City of Portsmouth, Virginia (2006), the group housing <br />use pcnnit shall expire for any portion of the approved project for which bltilding permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br />
