<br />R-07-08 <br /> <br />A RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE <br />PERMIT (GHP-06-15) TO THE ARH GROUPS TO CONSTRUCT I3 <br />RESIDENTIAL TOWNHOUSE UNITS AT 3711 AND 3715 TURNPIKE ROAD. <br /> <br />WHEREAS, Lloyd Vaughn, Jr., Managing Partner, The ARB Group, pursuant to <br />Section 40-112 of the Code of the City of Portsmouth, Virginia (2006), as amended, has <br />made application for the granting of a group housing use permit to construct 13 <br />residcntial townhouse at 3711 and 3715 Turnpike Road, Portsmouth, Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />GHP-06-15 <br /> <br />That parcel, described as beginning at a point in the <br />southern line of Turnpike Road, said point being 188 feet <br />west to the of the western line of Rodman Avenue. Thence <br />proceeding S 3I030'00"E 427.23 feet plus or minus, to a <br />point, thence S6301715"W 152.50 feet plus or minus, to a <br />point, thence N3l o30'OO"W 414.58 feet plus or minus, to a <br />point, thence N58031' 43"E 152 feet plus or minus, to the <br />point of beginning. Property is also known as 3711 and <br />3715 Turnpike Road, or in the future, I through 13 Empire <br />Court and all of Empire Court. <br /> <br />and <br /> <br />WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said application; <br />and <br /> <br />WHEREAS, the applicant has been informed that approval of the group housing <br />project pursuant to Section 40-1 ] 6 only grants an exemption trom certain requirements <br />for residences as stated in said section and does not constitutc a waiver of any other <br />requirement embodied in the City Subdivision Ordinance, the City Zoning Ordinance, or <br />any other applicable local, state or federal law or regulation; and <br /> <br />WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />I. That, coupled with the terms imposed by paragraph 2 hcreof, the <br />following conditions exist: <br />
