<br />ORDINANCE MO;'006-41 <br /> <br />AN ORDINANCE TO CLOSE A PORTION OF ARMSTRONG STREET. <br /> <br />WHEREAS, the Portsmouth Redevelopment and Housing Authority has requested the <br />closure of a portion of Armstrong Street, as hereafter described: and <br /> <br />WHEREAS, the Planning Commission, at a meeting held on May 2, 2006. <br />recommended approval of the closure and vacation of a portion of Armstrong Street; and <br /> <br />WHEREAS, notice of the proposed closure and vacation has been given the adjoining <br />propel1y owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Council ofthe City of Portsmouth, <br />Virginia that a portion of Armstrong Street be closed and vacated as a public street and right of <br />way in the City of Portsmouth, Virginia, as follows: <br /> <br />ARMSTRONG STREET- All that portion of Armstrong Street lying between <br />the northern right of way line of County Street and the southern right of way line <br />of King Street (now closed), being approximately 226 feet in length. more or less. <br />as shown on that certain exhibit attached hereto entitled "EXHIBIT SHOWING <br />PROPOSED CLOSURE OF ARMSTRONG STREET PORTSMOUTH, <br />VIRGINIA." <br /> <br />BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an <br />easement in the portions of Armstrong Street hereby closed and vacated for the installation. <br />operation. maintenance and replacement of public utilities of the City of Portsmouth, Virginia. <br />which said easements may be released and vacated by the City Manager of the City of <br />Portsmouth as he may in his discretion deem appropriate and in the best interest of the City of <br />Portsmouth. <br /> <br />BE IT FURTHER ORDAINED, that the City Manager is hereby authorized to execute <br />such deeds or other documents as he may deem appropriate and necessary to convey said rights <br />of said closed street to such entity as may be required by the adjoining property owners and may <br />release and vacate the easement hereby reserved for the City of Portsmouth as he in his <br />discretion deems appropriate and in the best interest of the City of Portsmouth. <br /> <br />Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on May <br />23. 2006. <br /> <br />Teste: <br /> <br />City Clerk <br />
