URDlNAIU __2006-38 . AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 30-121 AND 30-241 THEREOF PERTAINING TO VOCATIONAL REHABILITATION REQUIREMENTS FOR CERTAIN SERVICE-CONNECTED DISABILITY RETIREES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Sections 30-121 and 30-241 of the Code of the City of Portsmouth, Virginia (1988) each be amended and reordained by the adoption of a new subsection (d) to read as follows: ARTICLE 11. PORTSMOUTH SUPPLEMENTAL RETIREMENT SYSTEM Sec. 30-121. Service-connected disability retirement allowance. (d) Beginning July 1, 2006, and thereafter, in order to receive a service- connected disability retirement allowance, a member retiring on account of disability compensable under the Virginia Workers' Compensation Act shall participate in vocational rehabilitation following his or her release for light-duty occupations. This requirement shall not apply or will cease to apply if the member has attained or subsequently attains full service retirement eligibility as defined in sections 30-116, el seij. ARTICLE Ill. PORTSMOUTH FIRE AND POLICE RETIREMENT SYSTEM Sec.30-241. Service-connected disability retirement allowance. (d) Beginning July I, 2006, and thereafter, in order to receive a service- connected disability retirement allowance. a member retiring on account of disability compensable under the Virginia Workers' Compensation Act shall participate in vocational rehabilitation following his or her release for light-duty occupations.
