<br />OlJr1IU"-"'a.'" ..::t'1I200~6 <br />i liJ I1I"\I1b wu: l:. .." ~ <br /> <br />AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY ADOPTING A NEW SECTION 22-582 <br />AND BY AMENDING SECTIONS 22-578(a), 22-611(b), 22-642(b), AND 22-664(c) <br />THEREOF TO ESTABLISH NEW PENALTIES FOR ILLEGAL PARKING IN <br />THE DOWNTOWN BUSINESS DISTRICT. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the Code of the City of Portsmouth, Virginia (2006) be amended by <br />the adoption of a new Section 22-582 to read as follows: <br /> <br />Sec. 22-582. Downtown Busincss District defined. <br /> <br />For purposes of this Article, the Downtown Business District is defined as the <br />area bounded by Queen Street on the north, King Street on the south, Chestnut Street on <br />the west, and Water Street on the east. Thc area so bounded shall be deemed to <br />encompass both sides of each said street. <br /> <br />2. That Sections 22-578(a), 22-611(b), 22-642(b), and 22-664(c) of the Code <br />of the City of Portsmouth, Virginia (2006) be amended and reordained to read as follows: <br /> <br />Sec. 22-578. Procedure and penalties for parking violations. <br /> <br />(a) Except where otherwise provided, it shall be the duty of each police <br />officer of the city, or other uniformed employees of the police department whose normal <br />duties include parking enforcement, to give to the person opcrating a motor vehicle <br />illegally parked, a notice, or to attach to the vehicle found so parked, a notice to the <br />owner that the vehicle has been illegally parked and instructing him/her to report to the <br />city treasurer or the police records office of the police department to pay the penalty of <br />$25.00 or state objection to and intent to contcst the notice of violation. Provided, <br />however, the penalty for a violation in the Downtown Business District, as defined in <br />Section 22-582, shall bc $15.00. If the owner of the vehicle fails to make such payment <br />within 14 days of the time the notice was attached to the vehiclc, or state objection to and <br />intent to contest the notice of violation, he/she shall again be notified and an additional <br />penalty of $1 0.00 shall be charged for the additional notice. All monies due shall be paid <br />to the city treasurer or thc police records office of the police department who shall be <br />accountable therefor. Failure of the owner of the vehicle to pay the penalty for such <br />violatinn and the $10.00 for thc additional nntice within 2X days from the date of <br />vinlation, shall constitute a violation of this scction. Any person convicted of a violation <br />of this scction shall bc punishl'd by a tine of not less than ~25.00 nor Illorc than $100.00. <br /> <br />Scc.22-611. Procedure in case of violation. <br /> <br />(b) Each police ot1icer, or uniformed employee of the policc department <br />whose normal duties include parking enforcement, shall attach to the vehicle a notice to <br />
