<br />(a) Each such yard setback when applied to a structure shall be increased by <br />one foot for each foot of height of such structure above 35 feet. <br />(b) Parking and loading areas shall not be allowed in such yard setback. <br />(c) As a condition of approval of the housing project. the applicant shall be <br />deemed to have waived any right to seek a variance or special exception from the yard <br />setback requirements along lot lines adjoining single-family property, as described in this <br />section. <br /> <br />Sec. 40-118. Buffer requirements. <br /> <br />A landscaped buffer meeting the requirements of landscaping group 2 shall be <br />established and maintained in the side and rear yard setbacks required for a housing <br />project. <br /> <br />Sec. 40-119. Drainage requirements. <br /> <br />All housing projects shall comply with the off-site drainage requirements of <br />Section 33-33 of the City Code. <br /> <br />Sec. 40-120. Modifications of housing use permits. <br /> <br />The process for modification or changc of an approved housing use permit shall <br />be the same procedure required for approval of a housing use permit. <br /> <br />3. That Tables 40-43.1-], 40-43.1-2, and 40-43.1-3 of the Code of the City of <br />Portsmouth, Virginia (2006) be amended to show all uses formerly requiring a Group <br />Housing Use Permit (G) as requiring a Use Permit (*) and to remove the footnotes <br />therein referring to a Group Housing Use Permit (G). <br /> <br />4. That Conditions 64 and 65 of Section 40-43.4 of the Code of the City of <br />Portsmouth, Virginia (2006) be amended and reordained to read as follows; <br /> <br />Sec. 40-43.4. Conditions for specific uses. <br /> <br />(64)(a) The parking requirements for housing for the elderly may be modified by <br />City Council as specified in Section 40-45.1. <br />(b) Thc minimum tloor area requirement for housing lor the elderly may be <br />reduced by city council to no less than 475 square feet of t100r area per unit tor one- <br />bcdroom etlicicncy dwelling units through the approval of a housing use permit. No such <br />reduction shall be authorized cxccpt upon assurances satisfactory to the council that such <br />housing is dcsigned cxclusi\ely as housing for the elderly as dctined by this chapter. <br />Atier such rcduction has becn authorized the premises shall not be used othcr than for <br />housing lor thc eldcrly unless and until compliance with the minimum rcquired tloor arca <br />applicable to the ncw usc has bcen demonstrated. <br />(c) Housing for the elderly must comply with the "Special requirements lor <br />housing Jor the eldcrly" containcd in Chapter 7 of the Code. <br />
