<br />receptacles and it shall be unlawful to use same as thc sole means of storage of garbage <br />or refuse on any premises within the city. <br /> <br />(c) For dwellings and businesses using dumpsters, it shall be unlawful for <br />garbage or trash to be placed, deposited or allowed to remain on any premises within the <br />city unless same is placed or kept inside the dumpster. The dumpster shall remain closed <br />at all times. <br /> <br />Sec. 16-7. Litter receptacles in public places. <br /> <br />(a) As used in this section, a litter receptacle shall mean those containers <br />acceptable to the Director of General Services and which may be standardized as to size, <br />shape, capacity, color, and cover design which shall bear the state antilitter symbol. The <br />term "litter" as used in this section shall mean paper, waste materials, bottles, and cans, <br />but shall not include garbage, refuse, or bulk refuse. Large containers known as <br />"dumpsters" may be used as receptacles for the deposit oflitter if such use is approved by <br />the director. <br /> <br />(b) Litter receptacles shall be required in the following public places. The <br />minimum number of litter receptacles for each public place shall be specified herein. <br />Additional receptacles may be required by the director or his representative as determined <br />by the needs of a particular location. <br /> <br />(I) Sidcwalks in business districts. The need for receptacles and their <br />placement, and the responsibility for their maintenance and service, shall be <br />controlled by the director or his representative. <br /> <br />Sec. 16-31. Abatement of violations of division. <br /> <br />If an owner or occupant fails, refuses or neglects to comply with any provision of <br />this division after delivery or posting of reasonable notice of violation of this division, the <br />director may invoke the provisions of sections 16-2 or 16-5, and/or cause the nuisance or <br />the condition which is in violation of this division to be abated and may transmit to the <br />city treasurer a statement of all costs incurred thereby. Included in such costs shall be a <br />$150.00 fee to cover the administrative expense incurred and a fee of $250.00 per load or <br />portion thereof for the use of the city's waste management vehicles and equipment. All <br />such costs shall be added to the taxes assessed against the real estate on which the <br />nuisance or condition in violation of this division existed or ,he real estate abutting the <br />alley. sidewalk or street on which the nuisance or condition in violation of this division <br />existed. for the ensuing tax year and shall be collected with such taxes by any manner <br />prescribed by law for the collection of city taxes. All costs incurred thereby shall be <br />docketed as a lien against such real property. in the nuisance abatement lien docket book <br />maintained in the otlice of the city treasurer, which lien shall exist in the otlice of the city <br />treasmer until removed by payment of such cost" in fu;L <br />
