<br />GRDINAMCE MO 200~85 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 16 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 16-1, 16-2, 16- <br />5(a), 16-6, 16-7(a) AND (b)(I), 16-31, 16-32, 16-34 THROUGH 16-37, 16-39, 16- <br />62(c), 16-64, 16-66, 16-69, AND 16-70 THEREOF, BY ADOPTING NEW <br />SECTIONS 16-10 AND 16-60, AND BY REPEALING SECTIONS 16-63 AND 16- <br />65 PERTAINING TO THE COLLECTION OF GARBAGE AND REFUSE. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />I. That the definitions of "Bulk refuse," "Director," and "Industrial waste," <br />contained in 9 16-1 of the Code of the City of Portsmouth, Virginia (1988) be amended <br />and reordained. and that new definitions "Tires" and "White goods" be added thereto to <br />read as follows: <br /> <br />Sec. 16-1. Detinitions. <br /> <br />Bulk refuse: The term "bulk refuse" shall include bulky items such as household <br />construction debris not generated by a contractor, household construction debris not <br />generated by a contractor, furniture, tree trimmings, cuttings, shrubbery and the like. <br /> <br />Director: The word "director" shall mean the director of general services of the city or the <br />director's authorized representative. <br /> <br />Industrial waste: The term "industrial waste" shall include building material waste <br />resulting from erecting, removing, repairing, rcmodcling or razing buildings; used parts <br />from vehicles and tires of a size 800 x 20 and greater; ashes from boilers, incinerators, or <br />other trash or matter originating in a business or manufacturing establishment intended <br />not for use or sale. <br /> <br />Tires: The term "tire" shall mean a privately owned vehicle tire of a size less than 800 x <br />20. <br /> <br />White Goods: The term "white goods" shall mean large household appliances such as <br />refrigerators. water heaters and washing machines. <br /> <br />2. That 916-2 of the Code of the City of Portsmouth, Virginia (1988) be <br />amended by amending paragraph (c) thereof and adding new paragraph (d) thereto and <br />reordained to read as follows: <br /> <br />Sec. 16-2. <br /> <br />Violations of chapter. <br /> <br />(c) In accordance with 915.2-.298 of the Code of Virginia, the first violation <br />under this chapter excluding the provisions of section 16-35 shali result in a violation <br />notice being sent to the owner or ocwpant of the property.
