<br />. <br /> <br />. <br /> <br />. <br /> <br />uRDltWCE ..~OQ~53_ <br /> <br />AN ORDINANCE TO ADD A NEW SECTION TO THE PORTSMOUTH CITY CODE, <br />SECTION 24-311, DEALING WITH AUTHORIZATION OF THE PORTSMOUTH <br />POLICE DEPARTMENT TO ARREST PERSONS FOR TRESPASSING ON PRIV ATE <br />PROPERTY. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That, pursuant to the authority granted by Va. Code ~ 15.2-1717.1, the Code of the <br />City of Portsmouth, Virginia (1988) be, and hereby is, amended and reordained by adopting a <br />new section, numbered 24-311, as follows: <br /> <br />Section 24-311. Authorization of Portsmouth Police Department to arrest persons for <br />trespassing on private property. <br /> <br />The owner, lessee, custodian, or person lawfully in charge of any property may designate the <br />Portsmouth Police Department as a "person lawfully in charge of the property" for the purpose <br />of forbidding another to go or remain upon the lands, buildings or premises as specified in the <br />designation. The designation shall be in writing on a form approved by the City Attorney and on <br />file with the Portsmouth Police Department. The designation shall be admissible in evidence in <br />any applicable trespass prosecution, without requiring the presence or testimony of such actual <br />owner, lessee, or custodian. <br /> <br />2. That this ordinance shall take effect on the date of its adoption. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />June 28, 2005. <br /> <br />Teste: <br /> <br />City Clerk <br />
