<br />", <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />.' <br /> <br />ORDlNANCE .2005-50 _ <br /> <br />AN ORDINANCE TO AMEND CHAPTERS 11.1 AND 17 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY REPEALING SECTIONS <br />17-71 THROUGH 17-76, BY ADOPTING NEW SECTIONS 17-81 THROUGH 17- <br />92, AND BY ADOPTING A NEW SECTION 11.1-4 PERTAINING TO THE <br />INSPECTION OF RESIDENTIAL RENTAL DWELLING UNITS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That, after advertisement and a public hearing as required by Section 36- <br />105.1:1 of the Code of Virginia, 1950, Division III of Chapter 17 of the Code of the City <br />of Portsmouth (1950) pertaining to rental inspections is hereby amended and reordained <br />to read as follows: <br /> <br />DIVISION III. RENTAL INSPECTIONS. <br /> <br />Sec. 17-81. Legislative Intent. <br /> <br />This division is intended to protect the public health, safety and welfare of the <br />occupants of residential rental dwelling property units throughout the City and to assure <br />the maintenance of the City's rental housing stock. <br /> <br />The creation and designation of rental inspection districts in this division results <br />from a finding by the City Council that the residential dwelling units within a designated <br />rental inspection district are either (a) blighted or in the process of deteriorating, or (b) in <br />need of inspection by the City to prevent deterioration, taking into account the number, <br />age and condition of the residential dwelling units and that the inspection of residential <br />rental dwelling units inside each proposed rental inspection district is necessary to <br />maintain safe, decent and sanitary living conditions for tenants and other residents living <br />in the rental inspection district. <br /> <br />Sec. 17-82. Definitions. <br /> <br />For purposes of this article the following definitions shall apply: <br />" Building Maintenance Official" shall mean an officer or other designated <br />authority charged with the administration and enforcement of the provisions of the <br />Uniform Statewide Building Code dealing with existing structures or a duly authorized <br />representative. <br />"Building Official" shall mean an officer or other designated authority charged <br />with the administration and enforcement of the Uniform Statewide Building Code for <br />new construction and permit issuance or a duly authorized representative. <br />"Department" shall mean the Department of Community Relations and Leisure <br />Services for the City of Portsmouth. <br />"Director" shall mean the director of Community Relations and Leisure Services <br />for the City of Portsmouth or his designee. <br />
