ORDlNANCE .2005-50 _ AN ORDINANCE TO AMEND CHAPTERS 11.1 AND 17 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY REPEALING SECTIONS 17-71 THROUGH 17-76, BY ADOPTING NEW SECTIONS 17-81 THROUGH 17- 92, AND BY ADOPTING A NEW SECTION 11.1-4 PERTAINING TO THE INSPECTION OF RESIDENTIAL RENTAL DWELLING UNITS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That, after advertisement and a public hearing as required by Section 36- 105.1:1 of the Code of Virginia, 1950, Division III of Chapter 17 of the Code of the City of Portsmouth (1950) pertaining to rental inspections is hereby amended and reordained to read as follows: DIVISION III. RENTAL INSPECTIONS. Sec. 17-81. Legislative Intent. This division is intended to protect the public health, safety and welfare of the occupants of residential rental dwelling property units throughout the City and to assure the maintenance of the City's rental housing stock. The creation and designation of rental inspection districts in this division results from a finding by the City Council that the residential dwelling units within a designated rental inspection district are either (a) blighted or in the process of deteriorating, or (b) in need of inspection by the City to prevent deterioration, taking into account the number, age and condition of the residential dwelling units and that the inspection of residential rental dwelling units inside each proposed rental inspection district is necessary to maintain safe, decent and sanitary living conditions for tenants and other residents living in the rental inspection district. Sec. 17-82. Definitions. For purposes of this article the following definitions shall apply: " Building Maintenance Official" shall mean an officer or other designated authority charged with the administration and enforcement of the provisions of the Uniform Statewide Building Code dealing with existing structures or a duly authorized representative. "Building Official" shall mean an officer or other designated authority charged with the administration and enforcement of the Uniform Statewide Building Code for new construction and permit issuance or a duly authorized representative. "Department" shall mean the Department of Community Relations and Leisure Services for the City of Portsmouth. "Director" shall mean the director of Community Relations and Leisure Services for the City of Portsmouth or his designee.
