That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance which now zones as Commercial C-2-K (Conditional) <br />the property described in Petition for Zoning Amendment Number Z-05-02, is hereby <br />amended and changed so as to show said property zoned as Commercial C-2-K <br />(Conditional), and that said property is hereby zoned as Commercial C-2-K <br />(Conditional), <br /> <br />2. <br />follows: <br /> <br />That the property affected by this ordinance is furthermore described as <br /> <br />Z-05-02 <br /> <br />Beginning at a point 125'010 north and 200'010 west of the <br />northwest intersection of Forest Haven Lane and Western Branch <br />Boulevard; thence, in a northerly direction 525'010 to a point: <br />thence, in a westerly direction 795.53'010 to a point; thence, in a <br />southerly direction 416'010 to a point; thence, in an easterly direction <br />234.52'010 to a point; thence, in a southerly direction 40'010 to a point; <br />thence, in an easterly direction 360'010 to a point; thence, in a <br />northerly direction 100.60'010 to a point; thence, in an easterly <br />direction 200'010 to the point of beginning. <br /> <br />3. That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning: <br /> <br />(a) The use of the property will be limited to new and used motor vehicle <br />sales and service, (S.I.C. 551) together with related office, parking, <br />drainage, public utility and open space usage. <br /> <br />(b) The proposed motor vehicle dealership and related facilities will be <br />operated on the property in general accordance with the site layout exhibit <br />submitted by the applicant. The edge of the parking lot in the rear of the <br />property adjacent to the residential zone will be set back approximately <br />seventy feet from the property line. The below described landscaped <br />buffer and BMP will be situated between the property line abutting the <br />residential zone and the edge of the rear parking lot. <br /> <br />(c) <br /> <br />A twenty-foot wide strip ofland along the property bordering the <br />residential zone will be reserved by a declaration of covenants benefiting <br />the City of Portsmouth for a landscaped buffer in a form subject to the <br />
