<br />. <br /> <br />. <br /> <br />. <br /> <br />lien on the real estate from which said vehicle was removed. The lien and costs may be <br />collected in the same manner local taxes are collected. <br /> <br />(e) No vehicle shall be released until the registered owner/lien holder attests <br />on a form approved by the city attorney that: <br /> <br />(1) the vehicle, upon release, will be housed in a fully enclosed building or <br />structure, or removed from the City of Portsmouth until all repairs needed <br />to make the vehicle operable are completer and all required licenses and <br />inspection decals are properly displayed; or <br />(2) the vehicle, upon release, will be immediately transported to a repair <br />facility where it will remain until all necessary repairs are completed and <br />licenses and inspection decals are properly displayed; or <br />(3) the vehicle, upon release, will be brought into compliance by correcting all <br />violations ofthe criteria specified in section 23-46(a) hereof. <br /> <br />(f) In the event that an inoperable motor vehicle is returned to the subject <br />property after removal pursuant to the notice requirement in (a) above, and all cited <br />violations have not been corrected, a continuing violation will be deemed to exist. No <br />further notice or other action shall be required on the part of the city prior to the towing <br />of the vehicle from the site, and the assessment of all allowed costs and fees. <br /> <br />(g) In the event that notice of an inoperable motor vehicle has been given in <br />accordance with section 23-48 and the vehicle is not accessible for towing due to its <br />location behind a locked gate, fence, car or other physical obstruction, the owner of the <br />property shall be guilty of a Class 1 misdemeanor if the obstructions is not promptly <br />removed at the request of the director. <br /> <br />2.
