<br />. <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO.2005-11 <br /> <br />AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 23-46 <br />THROUGH 23-48 AND 23-50 THEREOF PERTAINING TO INOPERABLE <br />MOTOR VEHICLES. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That Sections 23-46 through 23-48 and 23-50 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to read as follows: <br /> <br />ARTICLE III. INOPERABLE VEHICLES <br /> <br />Sec. 23-46. Prohibition against open storage on certain property. <br /> <br />(a) It shall be unlawful for any person to keep, except within a fully enclosed <br />building or structure or otherwise shielded or screened from view, on any property zoned <br />for residential or commercial purposes, any motor vehicle, trailer, or semi-trailer, as <br />defined by section 46.2-100 of the Code of Virginia, which: <br /> <br />(I) <br />(2) <br /> <br />is not in operating condition; or <br />for a period of 60 days or longer has been partially or totally disassembled <br />by the removal of tires, wheels, the engine or other essential parts required <br />for the operation of the vehicle; or <br />lacks either a current license plate, or a current state inspection decal. <br /> <br />(3) <br /> <br />(b) F or purposes of this Article, the following definitions shall apply: <br /> <br />(I) Property zonedfor residential purposes. Property zoned for residential <br />uses under Chapter 40 of this Code. <br />(2) Property zonedfor commercial purposes. Property zoned for non- <br />residential uses under Chapter 40 of this Code. <br />(3) The term fully enclosed building or structure shall not include a tent or <br />other shelter with cloth of fabric covering the exterior of an air supported <br />structure. <br />(4) The term shielded or screenedfrom view shall mean: <br /> <br />(i) the covering of the vehicle with a fitted car cover; or <br />(ii) the placing of the vehicle behind a privacy fence of sufficient <br />height to shield the vehicle from the view of a person <br />standing at ground level from the outside of the property on <br />which the subject vehicle is located; or <br />(iii) the placing of the vehicle behind a solid vegetated hedge of <br />sufficient height or density to shield the vehicle from the <br />view of a person standing at ground level from outside of the <br />property on which the subject vehicle is located. <br />
