That the subject property shall be subject to the following conditions as <br />proffered by the applicant for rezoning: <br /> <br />. <br /> <br />(a) <br /> <br />The application/rezoning for the subject property includes the utilization <br />of the Traditional Neighborhood Development (TND) Overlay District <br />and will not be developed without use of the Traditional Neighborhood <br />Development conditions and precepts. <br /> <br />(b) The subject property shall be developed in accordance with the submitted <br />Plans (dated December 23, 2003 and revised on January 13, 2004 and <br />February 3, 2004) and Development Guidelines (dated January 14, 2004 <br />and revised February 3, 2004), as prepared by the Lessard Architectural <br />Group, Inc. The City of Portsmouth Director of Planning and Zoning may <br />approve minor modifications to the Plans and the Development <br />Guidelines. <br /> <br />(c) As part of the application, the owner will dedicate property to the City of <br />Portsmouth, as shown on the Conceptual Site Plan-Phase 1, adjacent to <br />the existing school, Greenwood Drive, and Independence Street. The area <br />of the dedication is approximately 1.5 acres. <br /> <br />(d) Construction of the clubhouse and swimming pool, as shown on the <br />Conceptual Site Plan-Phase 1, shall commence prior to the issuance of <br />more than 25% of the building permits for Phase 1. <br /> <br />. <br /> <br />(e) <br /> <br />The owner and any successor in interest shall implement Recommendation <br />Items 5 and 7 set out on page 31 of the Traffic Impact Assessment for <br /> <br />
