<br />8RD1NANC[NO~ 2 ~~. <br /> <br />. <br /> <br />AN ORDINANCE TO PROHIBIT THE RENTAL OF HOTEL AND MOTEL ROOMS <br />FOR ILLEGAL OR UNLAWFUL PURPOSES OR FOR SHORT TERMS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />That the Code of the City of Portsmouth, Virginia (1988) be, and hereby is, amended and <br />reordained by enacting two new sections, numbered 24-264 and 24-265, as follows: <br /> <br />Sec. 24-264. Renting or occupying room for illegal or unlawful purposes. <br />It shall be unlawful for any person to rent or to occupy any room in any rooming house, hotel or <br />motel in this city for illegal or unlawful purposes, or for the proprietor, manager or other person <br />in charge of any such rooming house, hotel or motel to rent, assign to or permit any person to <br />occupy any such room, with knowledge that they intend to use it for illegal or unlawful purposes. <br /> <br />. <br /> <br />Sec. 24-265. Letting same room for a period ofless than one day. <br /> <br />It shall be unlawful for any person to let or to offer to let any room in any rooming house, hotel <br />or motel in the city by the hour, or for any period ofless than one day, or more than once <br />between the hours of9:00 p.m. and 6:00 a.m. of the next day. Provided, however, this <br />prohibition shall not apply to rentals for legitimate business, trade, conference, organizational, <br />governmental, corporate, or educational use, commonly known as "day rentals." A room which <br />is rented during any day for such a "day rental" may, at the conclusion of such use, be rented <br />again during the same day for normal private guest occupancy. <br /> <br />This ordinance shall take effect on the date of its adoption. <br /> <br />Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />September 13, 2005. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br />. <br /> <br />
