. . . . _._200~68_ ZONING AMENDMENT ORDINANCE Z-05-08 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: I. That the portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance which now zones as Commercial C-2-K (Conditional) the property described in Petition for Zoning Amendment Number Z-OS-08, is hereby amended and changed so as to show said property zoned as Commercial C-2-K (Conditional), and that said property is hereby zoned as Commercial C-2-K (Conditional). 2. follows: That the property affected by this ordinance is furthermore described as Z-05-08 Starting on the northwest corner of Cherokee Road and Chowan Drive at a point, thus in a westerly direction 80 feet +/- to a point, thus in a northerly direction 100 feet +/- to a point, thus in an easterly direction 80 feet +/- to a point, thus in a southerly direction 100 feet +/- to the point of beginning. 3. That the subject property shall be subject to the following conditions as proffered by the applicant for rezoning: (a) This property is to be rezoned for the purpose of operating a childcare center for no more than twenty (20) children, from the age of two and a half (2 1/2) years through the age of twelve (12) years. (b) Indoor hours of operation shall be limited to 6:00 a,m. to 6:00 p.m. (c) Outdoor play hours shall be limited to the hours of 8:00 a.m. to 6:00 p.m. (d) The outdoor play area shall be enclosed with a fence. (e) A minimum off our (4) parking spaces available on the site shall be exclusively for the use of the facility located at 300 Cherokee Road. (f) The center shall be constructed and operated in accordance with the submitted site plan and floor plan approved by City Council December 2003, revised per this request May 2005. (g) The center shall be constructed and maintained in accordance with the landscaping plan submitted approved by City Council August 2003.
