<br />. <br /> <br />. <br /> <br />. <br /> <br />shall be upon the body artist to prove that the body art was commenced at a legal time. <br /> <br />F. There shall be no sale, offering for sale, display, or exhibit in a body art studio of any <br />drug paraphernalia, including without limitation such items as rolling papers, rolling machines, <br />bongs, roach clips, water pipes, crack pipes, and hookahs. <br /> <br />G. No person shall state or imply in any advertisement or publication, written or oral and <br />prepared or uttered for the purpose of soliciting business, that a body art studio is endorsed, <br />regulated or approved by the city or by any of its departments or is conducted in compliance with <br />the terms of this section. <br /> <br />H. No tattoo artist shall tattoo, and no body piercer shall pierce, any sexually private area <br />ofa member of the opposite sex. <br /> <br />Sec. 3-304. Unlawful acts and practices. <br /> <br />It shall be unlawful for any person - <br /> <br />A. To perform or administer body art without a permit, or in violation of any other <br />requirement of this chapter. <br /> <br />B. To be a body art studio operator of any body art studio which does not have: (I) <br />current Zoning Clearance under Chapter 40; (2) a current permit from the Health Department; (3) <br />a current business license from the City of Portsmouth, and; (4) a current Certificate of <br />Occupancy for use as a body art studio, as applicable, issued by the Building Official. <br /> <br />C. To perform or administer body art to any person less than eighteen years of age, <br />knowing or having reason to believe such person is less than eighteen years of age except (i) in <br />the presence of the person's parent or guardian, or (ii) when done by or under the supervision of a <br />medical doctor, registered nurse or other medical services personnel licensed pursuant to Title <br />54.1 of the Code of Virginia in the performance of their duties. <br /> <br />D. To perform or administer body art to any person who is under the influence of <br />alcohol, or who is under the influence of drugs, or who is so mentally retarded, challenged, or <br />disoriented as to be unable to make an intelligent decision, or who is acting under coercion of <br />any type, or who for any reason is not capable of making an informed, intelligent, and voluntary <br />decision to obtain body art, <br /> <br />E. To perform or administer body art while under the influence of alcohol or while under <br />
