. EXHIBIT D INSURANCE 1. Manager's Insurance. At all times during this Agreement, Manager shall: (a) maintain commercial general liability insurance, including products and completed operations, bodily injury and property damage liability, contractual liability, independent contractors' liability and personal and advertising injury liability against claims occurring on, in, or about the Facility, or otherwise arising under this Agreement; (b) maintain umbrella or excess liability insurance; (c) maintain commercial automobile liability insurance, including coverage for the operation of owned, leased, hired and non-owned vehicles; (d) maintain appropriate workers' compensation and employer's liability insurance as shall be required by and be in conformance with the laws ofthe Commonwealth of Virginia; (e) maintain professional liability insurance and self-insured employment practices liability coverage; and . (1) maintain property damage and hazard insurance on personal property and fixtures owned by Manager. 2. Owner's Insurance. At all times during this Agreement, the Owner shall: (a) Maintain the following self insurance/third party insurance coverages: 1. Self-insured Statutory Workers Compensation including Employer's Liability Insurance of$350,000 and additional umbrella coverage of up to $5,000,000. 2. Self-insured Commercial Liability Coverage of $1,000,000 for personal injury and personal property claims and additional umbrella coverage of up to $10,000,000. 3. Self-insured Automobile Liability Coverage of$I,OOO,OOO for City vehicles; (b) maintain umbrella or excess liability insurance; (c) maintain commercial automobile liability insurance, including coverage for the operation of owned, leased, hired and non-owned vehicles; (d) maintain appropriate workers' compensation and employer's liability insurance as shall be required by and be in conformance with the laws of the Commonwealth of Virginia; . 26
