<br />. <br /> <br />Facility reasonably comparable to the number of events presented at other similar facilities (the Parties <br />agreeing that the foregoing does not affect any termination right the Owner may have under Article 3). <br /> <br />6. Obtain the highest commercially feasible revenues from operation ofthe Facility through all <br />available revenue sources, including without limitation, sale of regular tickets, sale of season or series <br />tickets, sale of sponsorships, sale of concession and related rights, and sale of merchandise. <br /> <br />7. Have the exclusive right to promote and book events and performances at the Facility. <br /> <br />8. Operate the Facility in the public interest, and in such a way as to reflect favorably on the <br />image of the City of Portsmouth, the Hampton Roads region, and the Commonwealth of Virginia. <br /> <br />9. To comply with all laws, rules, regulations and ordinances except to the extent noted in <br />Section 6.2 and section 14.4 hereof which shall be the responsibility of the Owner. <br /> <br />10. Use commercially reasonable efforts to maximize attendance/revenues. <br /> <br />11. Use all reasonable efforts to ensure compliance or performance with typical standards of <br />decency. <br /> <br />12. Seek diversity in its programming. <br /> <br />. <br /> <br />13. Endeavor to hold a community event in the plaza area ofthe Facility on a weekly basis during <br />the operating period of the Facility, subject to additional funding by Owner pursuant to a budget mutually <br />agreed upon by Owner and Manager. <br /> <br />14.
