Roadways. The Director of Public Works or his designee must approve a lighting <br />plan for the development prior to issuance of building permits. <br /> <br />(d) The applicant shall be responsible for the cost and upgrading of utilities <br />for this development. The applicant shall coord'mate design of the sewer line with <br />Director of Public Utilities. <br /> <br />(e) The property shall be fenced with a fence having a wrought iron <br />appearance supported by intermittent brick columns. <br /> <br />(f) The applicant must obtain an exception from Planning Commission to <br />construct the proposed 16ft. gazebo (with walking trail) or to remove the gazebo <br />completely. <br /> <br />(g) Any revisions to the site plan or landscaping plan or elevations made <br />through the group housing application process, including any changes by City <br />Council, must be submitted to the Director of Planning and Zoning for approval <br />prior to issuance of building permit. <br /> <br />(h) The applicant must comply with all regulations of federal, state and local <br />governments, and must obtain all required permits and approvals. <br /> <br />(i) Trash storage and removal services to the development shall be provided <br />by a private contractor, <br /> <br />(j) All taxes and fees owed in connection with the property shall be paid <br />when due. <br /> <br /> 2. EXPIRATION OF PERMIT: Unless extended as provided under <br />Section 40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing <br />use permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br /> 3. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the permit by the City Council. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on March 23, 2004. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
