2. That new Sections 11.1-2 and 11.1-3 be adopted to read as follows: Sec. 11.1-2. Wetlands application fees. A nonrefundable fee of $50.00 for single-family dwellings and $150.00 for all other uses shall be paid to the city treasurer for a permit for the use or development of any wetland within the city under the provisions of Chapter 39. A receipt showing such payment shall accompany each application for the same. The fee has been set by the city council with due regard for the services to be rendered, including the time, skill and administrator's expense involved. Sec. ll.l-3. Subdivision application and review fees. The following fees shall be paid to the city treasurer upon the filing of an application under Chapter 33. No application shall be considered complete unless accompanied by a receipt showing payment of the applicable fee. (a) Plat (subdivision or condominium): (1) Minor--Fifty dollars ($50.00) per application. (2) Major, preliminary--Ten dollars ($10.00) per dwelling unit with a minimum fee of one hundred dollars ($100.00); for land zoned commercial or industrial twenty-five dollars ($25.00) per lot with a minimum fee of one hundred dollars ($100.00). (3) Major, final--Ten dollars ($10.00) per dwelling unit with a minimum fee of one hundred dollars ($100.00); for land zoned commercial or industrial, twenty-five dollars ($25.00) per lot with a minimum fee of one hundred dollars ($100.00). (b) Subdivision variance--Fifty dollars ($50.00) per application; (c) Plat vacation--Fifty dollars ($50.00) per application; (d) Modification, resubdivisions, relocation of lot lines--Fifty dollars ($50.00) per application; (e) Modification without new lots or new improvements--Fifty dollars ($50.00) per application. Where multiple applications are involved or where one application involves multiple review, the fees shall be cumulative. The fees are processing fees and are retained by the city regardless of any official action or decision or of any action taken by the applicant. 3. That Sections 33-91, 39-84 and 40-151 of the Code of the City of Portsmouth, Virginia (1988) be repealed. 4. That this ordinance shall take effect on the date of its adoption.
