days after written notification to do so sent to the address shown in the register provided for in subsection (a) of this section, the bond posted pursuant to subsection (a) shall be forfeited and the principal and surety thereon shall be and become liable for and shall pay so much on account of such bond as may be necessary in order to perfect such work and, in addition thereto, shall pay any and all damages which may be occasioned to any person by reason of such defective or inadequate work. Sec. 7-31. Created; appointment, removal, etc., of building official. The department of the buildiug official and code enforcement of the city is hereby created and the executive official in charge thereof shall be known as the building official, who shall be appointed by the city manager. The building official shall not be removed from office except for cause, and after full opportunity has been granted him to be heard on specific and relevant charges by and before the city manager. The building official shall have general supervision of the division of the department of building inspections. Sec. 7-32. Division of building inspection. (a) The division of building inspection of the department of the building official and code enforcement shall be supervised by the Assistant to the Building Official/plans examiner, who shall have such assistants as may, from time to time. be authorized by the city manager and appointed by the building official. (b) The Assistant to the Building Official/plans examiner shall have any combination equivalent to five (5) years of exper/ence in the field of building construction and including two (2) years of experience as a building inspector. (c) Each building inspector shall have at least four (4) years' experience in the field of building construction. Sec. 7-98. Continuation of existing use and occupancy. The legal use and occupancy of any structure existing on September 1. 1975, for which it has been heretofore approved, may be continued without change, except as may be specifically covered in the code adopted by this article or in the property maintenance section of the Virginia Uniform Statewide Building Code or as may be deemed necessary by the building official for the general safety and welfare of the occupants and the public. Sec. 7-101. Inspections of work. The inspections required under the provisions of the building code shall be performed by an inspector from the department of the building official and code enforcement, or by a third party designated by the building Official upon notification from the permit holder or such holder's agent. Such inspector shall either approve that portion of the work as completed or shall notify the permit holder or his agent where such work fails to comply with the building code or departmental regulation.
