days after written notification to do so sent to the address shown in the register provided <br />for in subsection (a) of this section, the bond posted pursuant to subsection (a) shall be <br />forfeited and the principal and surety thereon shall be and become liable for and shall pay <br />so much on account of such bond as may be necessary in order to perfect such work and, <br />in addition thereto, shall pay any and all damages which may be occasioned to any person <br />by reason of such defective or inadequate work. <br /> <br />Sec. 7-31. Created; appointment, removal, etc., of building official. <br /> <br /> The department of the buildiug official and code enforcement of the city is hereby <br />created and the executive official in charge thereof shall be known as the building <br />official, who shall be appointed by the city manager. The building official shall not be <br />removed from office except for cause, and after full opportunity has been granted him to <br />be heard on specific and relevant charges by and before the city manager. The building <br />official shall have general supervision of the division of the department of building <br />inspections. <br /> <br />Sec. 7-32. Division of building inspection. <br /> <br /> (a) The division of building inspection of the department of the building <br />official and code enforcement shall be supervised by the Assistant to the Building <br />Official/plans examiner, who shall have such assistants as may, from time to time. be <br />authorized by the city manager and appointed by the building official. <br /> (b) The Assistant to the Building Official/plans examiner shall have any <br />combination equivalent to five (5) years of exper/ence in the field of building <br />construction and including two (2) years of experience as a building inspector. <br /> (c) Each building inspector shall have at least four (4) years' experience in the <br />field of building construction. <br /> <br />Sec. 7-98. Continuation of existing use and occupancy. <br /> <br /> The legal use and occupancy of any structure existing on September 1. 1975, for <br />which it has been heretofore approved, may be continued without change, except as may <br />be specifically covered in the code adopted by this article or in the property maintenance <br />section of the Virginia Uniform Statewide Building Code or as may be deemed necessary <br />by the building official for the general safety and welfare of the occupants and the public. <br /> <br />Sec. 7-101. Inspections of work. <br /> <br /> The inspections required under the provisions of the building code shall be <br />performed by an inspector from the department of the building official and code <br />enforcement, or by a third party designated by the building Official upon notification <br />from the permit holder or such holder's agent. Such inspector shall either approve that <br />portion of the work as completed or shall notify the permit holder or his agent where such <br />work fails to comply with the building code or departmental regulation.
