AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ADDING THERETO A NEW ARTICLE <br />V PERTAINING TO MOSQUITO CONTROL. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Chapter 23 of the Code of the City of Portsmouth, Virginia (1988) be <br />amended by adding theretoa new Article V to read as follows: <br /> <br /> ARTICLE V. MOSQUITO CONTROL <br /> <br />See. 23-101. Purpose. <br /> <br /> Pursuant to the powers granted for abatement of nuisances under Section 15.2- <br />1115 of the Code of Virginia and in order to protect the health, safety, and welfare of the <br />citizens of the City, this Article establishes a program for mosquito control, including, but <br />not limited to, identification and treatment of breeding sources, public education, and <br />enforcement for the purpose of controlhng mosquito breeding, which may affect the <br />health, safety and welfare of the citizens. <br /> <br />Sec. 23-102. Enforcement. <br /> <br /> The city manager or his designee is authorized to implement and enforce the <br />provisions of this article. <br /> <br />Sec. 23-103. Mosquito breeding places; notice and abatement. <br /> <br /> (a) All premises shall be maintained in a manner so as to prevent the breeding <br />of mosquitoes thereon. No owner, agent, occupant or person in control of any premises m <br />the city may dig or permit a hole wherein any water may settle and remain in such a way <br />as to contribute to the breeding of mosquitoes. Any such person who fails to treat or abate <br />a mosquito breeding place after having been issued written notice of the same, and within <br />the period of time so fixed in the written notice, shall be guilty of a Class 4 misdemeanor. <br />Any water that has so collected is deemed to constitute a public nuisance detrimental to' <br />the public health and welfare. <br /> <br /> (b) Collections of water to be considered as included within the provisions of <br />this article are those which are contained in ditches, ponds, retention ponds, swimming <br />and decorative pools, lakes, creeks, depressions, privies, vaults, fountains, cisterns, tanks, <br />wells, barrels, troughs (except drink/ng troughs in constant use), urns, cans, tubs, buckets, <br />bottles, defective house gutters or any other containers in which water can collect. <br /> <br /> (c) Approved methods of treatment or abatement of collections of water <br />regulated by this article may include one or more of the following: <br /> <br /> <br />
