AN ORDINANCE TO AMEND AND REORDAIN THE CODE OF THE CITY OF <br />PORTSMOUTH BY ADDING THERETO A NEW ARTICLE WITHIN CHAPTER 2, <br />9dlTICLE XXIII, RELATED TO EMERGENCY CURFEWS. <br /> <br />BE 1T ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the Code of the City of Portsmouth, Virginia (1988) be, and hereby is. mended and <br />reordained by adding thereto a new Article within Chapter 2, Article XXIII, related to Emergency <br />Curfews and containing new sections numbered 2-683, 2-684, 2-685, and 2-686, as follows: <br /> <br />ARTICLE XXIII, EMERGENCY CURFEWS. <br /> <br />Section 2-683. Emergency Curfew. <br /> <br />Whenever an emergency has been declared in Portsmouth in a manner authorized by law, then an <br />Emergency Curfew may be ordered by the City Manager for the purpose of protecting public <br />safety, public welfare, public and private property, and good order, as set forth in this Article. <br /> <br />Section 2-684. Effective Date and Time; Duration. <br /> <br />An Emergency Curfew shall be effective immediately upon the City Manager declaring it in <br />writing. An Emergency Curfew may not remam in effect for longer than fourteen days without <br />approval by vote of City Council. It shall in any event be confirmed, extended, modified, or <br />ended by City Council not later than the next regularly scheduled Council meeting after it has <br />been declared. An Emergency Curfew shall not be permanent, and it shall not extend past the <br />time at which the applicable authority determines, in its sole discretion, that the emergency no <br />longer exists. <br /> <br />Section 2-685. Terms and Conditions. <br /> <br />An Emergency Curfew may contain such terms and conditions as are deemed necessary and <br />proper to deal with the emergency at hand, including, without limitation, geographic scope within <br />the City, curfew hours, application to businesses as well as individuals, and exceptions. <br /> <br />Section 2-686. Required condition for violation. Penalty. <br /> <br />A person must be informed of an Emergency Curfew and given an oppommity to comply with it <br />before being in violation. Violation of an Emergency Curfew shall be a Class 1 misdemeanor. <br /> <br />2. That this ordinance shall take effect on the date of its adoption. <br /> <br /> <br />
