R-03-63 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATE <br />AND RECOMMEND A CONTRACT FOR REPAIR OF THE NTELOS <br />PAVILION AT HARBOR CENTER. <br /> <br /> WHEREAS, on September 18, 2003, the roof of the nTelos Pavilion at Harbor <br />Center was severely damaged by storm-related winds; and <br /> <br /> WHEREAS, performances at the Pavilion for the remainder of 2003 were <br />canceled as a result of the damage, and performances for the 2004 season cannot be <br />scheduled unless the timely replacement of the roof is assured; and <br /> <br /> WltEREAS, the closure of the nTelos Pavilion has seriously affected and will <br />continue to affect the City of Portsmouth by the loss of taxes and other revenues related <br />to the Pavilinn's operation, by the loss of business proceeds for City merchants, and by <br />the removal of a major local entertainmem site and icon for the citizens of the City; and <br /> <br /> WHEREAS, time is of the essence with respect to the replacement of the roof if <br />the Pavilion is to reopen for the full 2004 concert season: and <br /> <br /> WHEREAS, it is in the best interest of the City that neither sealed bids nor <br />competitive negotiations be required as part of the procurement process for the nTelos <br />Pavilion roof repairs because the additional time necessitated by the sealed bid and <br />competitive negotiation processes makes timely completion of the repairs infeasible. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that pursuant to Section 12-215 (c) of the Code of the City of <br />Portsmouth, Virginia (1988), the City Manager be, and he hereby is, authorized to <br />select a proposed contractor for the repair of the nTelos Pavilion under such terms and <br />conditions as he shall deem in the best interest of the City. In so doing, the City <br />Manager shall give appropriate weight to the following four criteria: (a) price; (b) the <br />ability to complete the work expediently; (c) experience and qualifications; and (d) <br />integrity and honesty. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager shall recommend that <br />proposed contractor to City Council for its approval and authorization, supported by <br />such facts and reasons as support his recommendation. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting <br />held on November 14, 2003. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
