AN ORDINANCE TO AMEND CHAPTER 37 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY ADOPTING NEW SECTIONS 37-251 <br />THROUGH 37-251.4 CREATING A TOWING ADVISORY BOARD. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Chapter 37 of the Code of the City of Portsmouth, Virginia (1988) be <br />amended by adding thereto new Sections 37-251 through 37-251.4 to read as follows: <br /> <br />Sec. 37-251. Towing Advisory Board; creation; composition.. <br /> <br /> (a) There is hereby established an advisory board to be known as the "towing advisory <br />board." <br /> <br /> (b) The board shall derive its authority from and be administered by the city council. <br /> <br /> (c) The board shall be appointed by the council and shall consist of the following: <br /> <br /> (1) The Chief of Police or his designee; <br /> (2) The Director of General Services or his designee; <br /> (3) The Director of Planning and Inspections or his designee; <br /> (4) Two representatives from the towing and recovery operator community; and <br /> (5) Two residents of the city. <br /> <br /> (d) The members of the board shall be appointed for terms of three years. However, the <br />first appointed members shall have staggered terms with one member from (c)(4) and one <br />member from (c)(5) above being appointed for two-year terms and the balance of the <br />membership being appointed for three-year terms. All subsequent appointments shall be for <br />three-year terms. The council shall fill all vacancies on the board for the unexpired portion of the <br />term. Members shall serve until their resignation or their replacement by the council. <br /> <br /> (e) The members of the board shall serve without compensation. <br /> <br />Sec. 37-251.1. Removal of members. <br /> <br /> The city council may remove any member of the board at any time if it finds that the best <br />interest of the board would be served by such action. <br /> <br />Sec. 37-251.2. Election of officers; adoption of bylaws and rules of procedure. <br /> <br /> (a) The board shall elect annually a chairperson, a vice-chairperson and secretary from <br />among its members. <br /> <br /> (b) The board shall establish its own set of bylaws and roles of procedure. <br /> <br /> <br />
