Sec. 38-83. Meter rates for water supplied. <br /> <br /> (a) For all water which passes through meters, customers within the corporate <br />limits of the city shall Pay $2.80 per one thousand gallons or $2.0947 per one hundred <br />cubic feet of water supplied. <br /> <br /> (b) For all water which passes through meters, customers of the City of <br />Chesapeake who are served by Portsmouth and whose rates are not set by contract shall <br />pay $4.20 per one thousand gallons or $3.1420 per one hundred cubic feet of water <br />supplied. <br /> <br /> (c) For all water which passes through meters to the City of Chesapeake <br />pursuant to contract, the City of Chesapeake shall pay: <br /> <br /> (1) For the first three million gallons of water per day of water <br />suppl/ed during a billing period, $4.20 per one thousand gallons or $3.1420 per <br />one hundred cubic feet of water supplied. <br /> <br /> (2) For the amount of water supplied during a billing period in excess <br />of three million gallons of water per day, $3.36 per one thousand gallons $2.5136 <br />per one hundred cubic feet of water supplied. <br /> <br /> (d) For all water which passes through meters to the City of Suffolk pursuant <br />to contract, the City of Suffolk shall pay $2.570 per one thousand gallons or $1.9226 per <br />one hundred cubic feet of water supplied. <br /> <br />Sec. 38-94. Discontinuing service for failure to pay and other remedies. <br /> <br /> (c) When water or sewer use without execution of a contract for service or <br />without payment of applicable rates, fees and other charges is discovered at a premises, a <br />charge for the use together with an additional charge for detection shall be levied against <br />the owner, occupant, or tenant occupying the premises. The owner of the property shall <br />be responsible for payment of such charges for use and the additional charges for any <br />period of time when a tenant does not occupy the property. For purposes of this section, <br />evidence of occupancy by a tenant shall be a valid, dated, and properly executed lease <br />between the owner and tenant provided to the Department of Public Utilities. The charge <br />for water and sewer use shall be set by the Department of Public Utilities based upon the <br />actual metered water usage at the premises. Should no metered water usage be available <br />at the premises, the charge for water and sewer use shall be set by the Department of <br />Public Utilities at a level equal to recover the estimated use for the time period in <br />question. An additional charge of $25.00 shall be charged to recover the cost of <br />detection. Additionally, should the water or sewer use involve the use of an unauthorized <br />meter, the unauthorized use of a city-owned meter, or any type of unauthorized <br />connection to the city water or sewer system, then the $12.00 inspection fee in Section <br />38-94. (b) shall be applied. <br /> <br /> <br />
