AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING TABLE 40-444 <br />PERTAINING TO DIMENSIONAL REQUIREMENTS FOR NONRESIDENTIAL <br />DISTRICTS, SECTION 40-43.4(1) PERTAINING TO ACCESSORY USES AND <br />STRUCTURES, AND SECTIONS 40-71.2(e) AND 40-73(c) AND (e) PERTAINING <br />TO PARKING LOT SCREENING AND LANDSCAPING REQUIREMENTS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. Sections 40-43.4 (1), 40-7t.2(e), and 40-73 (c) and (e) be amended and <br />reordained to read as follows: <br /> <br />Sec. 40-43.4. Conditions for specific uses. <br /> <br /> The following conditions apply to the specified uses, as indicated in the <br />"Condition" column on the use schedule: <br /> (1) Limited to accessory uses and structures which would not create a <br /> nuisance or hazard and are customarily incidental to any permitted <br /> residential use such as garages, greenhouses or workshops, provided that <br /> none shall be inhabited. The total floor area of any accessory structures <br /> shall not exceed the lesser of 75% of the area of the primary building <br /> footprint or six hundred square feet and shall not exceed the height of the <br /> primary structure. Tractor trailers, automobiles, trucks and metal <br /> containers designed for freight and cargo are prohibited as accessory <br /> structures in residential zoning districts. <br /> <br />Sec. 40-71.2. Parking lot screening and landscaping requirements. <br /> <br /> In all zoning districts where four (4) or more off-street parking spaces are <br />permitted or required, the following parking facility requirements shall be observed: <br /> <br /> (e) Where off-street parking areas abut any public street or walk, landscaping <br />shall be provided between the parking area and the street right-of-way. This landscaping <br />shall consist of one (1) of the following: <br /> <br /> (1) A buffer strip of land meeting the requirements of landscaping group 3; or <br /> (2) A strip of land at least ten feet in width contain/ng an earth berm at least <br /> 30 inches in height above grade. The berm shall be completely covered <br /> with any combination of shrubs, grass or other living ground cover and <br /> shall not exceed a slope of 30 degrees or <br /> <br /> <br />
