A~'~ ORDINANCE TO PROVIDE FOR THE ACQUISITION OF <br />CERTAIN PROPERTY IN NANSE~OND COLrNTY, VIRGINIA, <br />NECESSARY FOR USE BY THE CITY FOR WATERWORKS AND <br />RELAT~u FACILITIES, PUg~UA~%~T TO CHAPTER 258 OF <br />THE ACTS OF ASSEMBLY OF 1958o <br /> <br /> WHERFAS, the City of Portsmouth has found it to~e necessary to enlarge its <br />waterworks system to meet the demands of the area served ~y it and is in the pro- <br />cess of constructing certain additional dame s~.d reservoirs to provide much needed <br />r~ww~ter storage; and <br /> <br /> W~J~RFAS, the City of Portsmouth has not ~een able to ~rchase certain ~ogerty <br />necessa~ to this ~o~ect after le~thy negotiations ~d advanc~ent of the work <br />will be delay~ ~reasonably if the said property is no~ ~de available as s~n as <br />~smibte; <br /> <br /> NOW, 'r~REFORE, Be it ordained by the Co~ncil of the City of Portsmouth, Vir- <br />ginia~ that the City Attorney is directed to institute eminent domain proceedings <br />against the parcel of pro~rty hereinafter described, in acco~ance wi~ and <br />S~nt to S~ti~ 23-f of the C~rter of the City of Portsmom~ (c~p~er ~58 of the <br />Acts of Asse~ly of 195~), and that the s~ hereinafter specifi~ with respect to <br />said ~rcel ~e deDosit~ to the c~i~ of the co~t ~s provided ~y <br /> <br /> The I~ud to be acquired in fee simple, its owner, the approximate area thereof, <br />and the amoun~ to be p~id into court are as follows: <br /> <br /> That certain parcel of land situate in Nansem~md County, Virginia, more par- <br />ticularly described as follows: <br /> <br /> Beginning at a point on the property line separating the lands of the James A. <br />Edwards Estate and B. E. Parker approximately 362~5' hearinE S t0° 41' W from the <br />centertine of State Highway Route 838; thence S 75° 15' E ~ distance of 122o8' to <br />a point designated '~-3"; thence S 10° 27' E a distance of 245.0' to a point desig- <br />nated "C-4"; thence S 77° $2' E ~ distance of 219.1' to a point designated <br />thence $ 1° 06' E a distance of 114.2' to a 24 inch pine tree; thence N 67° 04~ E <br />a distance of 145.1~' to a point which is located 2.9' bearing S 67° 04' W of <br />15 inch oak tree; thence S 0° 3?' W approximately 250' to Cohoon Creek; thence along <br />the northern bank of Cohmon Creek in a westerly direction to a point marked by a <br />stake located between two sycamore trees; thence N 12° 37' E a distance of 326' to <br />a stake desigmated as "Station 5S1 ~ 80 Line B"; thence N 10° 41' E a distance of <br />115.0' ~o the point of beginning. <br /> <br /> The hereinabove described property contains 5:31 acres, more or less, and <br />is b~)%mded on the north by the re~aining lands of James E. Ed~rds Estate, E~st by <br />the William Thomas Copelsnd Estate, ~outh by Cohoon Creek and West by land formerly <br />oR, led by Bo Em lmarker, now owned by the City of Portsmouth. <br /> <br /> For a more ex~ct description reference is hereby made to the plat entitled <br />"Water Department, City of Portsmouth, Virginia, Proposed Reservoir Cohoon Creek <br /> <br /> <br />
