~-N ORDINANCE [DO ~_~END SECTIONS 3-1, 3-14, 3-15 ~ 3-17 OF ~ <br />CODE OF ~E CI~ ~ PO~T~O~, 1951~ A~ORIZING ~E CI~ <br />~G~ TO CON--CT Wi~ ~E ~RT~-N~O~ C~ ~ <br />E~I~, INC.. FOR D~ ~D ~D ~R SERVICES. ~ <br /> <br /> Be it ordained by the Council of the City of Portsmouth, Virginia, that <br />Sections 3-1, 3-14, $-15 and 3-17 of the Code of thc City of Portsmouth, Vir~inia~ <br />1951, be ameaded and re-ordained to read as follows: <br /> <br />Section 3-1. Appointment, powers and duties, term and salary of <br /> <br /> ~ne city manager shall~ upon the execution of a contrac~ with the Ports- <br />mouth-Norfolk County Pkm~ne Society~ Inc0~ concerning the enfdrcement of the laws <br />relating to dogs~ and so long as such contract remains in force, appoint an ex <br />officio game warden for the city. Such ex officio game warden shall have po~lice <br />powers a~ud the powers and duties o*- a game w~rden within the limits of the city, <br />and he shall be charged with the duty of enforcin~ the hunii~, trapping, inland <br />fish and dog laws of this state ~ He shall require the owners of does to <br />license t~x imposed upon them, and he shall deliver to the Portsmo~h~Norfolk <br />County ~{umane Society, Inc~ any do~s of unknown ownership found rdnning at large <br />in the city and on which a license has not been paid, and he shall require aLll per- <br />sons in the city to fully comply with the dog laws of the state. <br /> <br /> He shall hold office during the pleasure of the~eity manager, and he <br />shall receive such salary as may be fixed by the city <br /> <br />Section 3-14~ Lmpounding ~ <br /> <br /> It shall be the dnty of the game warden to ca,ch and~ turn over to the <br />Portsmouth-Norfolk Coun%y Mum~ne Socisty, Inc., for impounding any dogs found off <br />the owaer's premises, unless Such do~ is accompanied by an a~tendant~ held in <br />leash 5y a responsible person or securely muzzled~ as provided in the preceding <br /> <br />Section 3-15~ Same-Redemption° <br /> <br /> Every dog so impou~uded sh~ti be penned for five days fro~ the time of <br />capture, during which time it may be redeemed by the owner paying ~o the attendant <br />az the do~ pound the s~m of two dollars and fifty cents per day, prorated wi~h a <br />minimum fee of one dollar, to cover the cost of maintaining,a pen for such dogs <br />and of the care and keep of such dog, and exhibiting to the person in charge of <br />the do~ pound the receip~ for the tax required to be Paid by state lawo All such <br />impounding fees shall be paid over to the City Treasurer monthly, <br /> <br />Section S-17~ Ss_me - Disposition of unredeemed dog. <br /> <br /> If noz redeemed ~ithin five days, such dog shall be disposed of~ other <br />than by sale~ by the Portsmouth-Norfolk County ~umane Society, thc. <br /> <br /> This ordinance being necessary for the public health, morals and safety, <br />an emergency is dectared~to exist aad it shall take ~effect from its passage° <br /> <br /> <br />
