AN ORDINANCE TO A~UEND ARTICLE IX OF CHAPTER 30 OF THE CODE OF <br />THE CITY OF PORTSMOLrI~, VIRGINIA, 1951, A~ACTED ON OCTOBER <br />1957, AS AMENDED, BY ADDING q~HERETO SECTIONS 30-175 THROUGH <br />30-179, INCLUSIVE, PROVIDING FOR THE OPERATION OF PROCTOR <br />SQUARE PARKING LOT WITH ATTENDANTS AND TIME-STAMPED TICKETS, <br />AUTHORIZING CONTP~CTS FOR VALIDATION OF TICKETS, AND DEFINING <br />VIOLATIONS THEREOF. <br /> <br /> Be it ordained by the Council of the City of Portsmouth, Virginia, that <br />Article IX of Chapter 30 of the Code of the City of Portsmouth, Virginia, 1951, <br />enacted on October 8, 1957, as amended, be amended by adding thereto Sections <br />30-175 through 30-179, to read as followsr <br /> <br />Section 30-175. Proctor Square Parking Lot - Operation by Attendants. <br /> <br /> Notwithstanding any other provisions of this Article, the City Manager <br />may remove the parking meters from Proctor Square Parking Lot and thereafter <br />collect D~rking fees for use of said lot through a system whereby an attendant <br />will issue a time-stamped ticket which may be satisfie6 upon cash payment by the <br />operator of the motor vehicle, by validation of the ticket by one or more mer- <br />chantile establishments Participating in the system, or both. <br /> <br />Section 30-176. Sam~ - Contrac~ with Underwriting ~erchan~ile Estab- <br /> lis.hments. <br /> <br /> Before convertin~ Proctor Square Parkin~ Lot as provided in Section <br />30-175 hereof, the City Manager shall enter into a contract, in form approved by <br />the City Attorney~ with one or more merchantile establishments licensed to do <br />business in this city° Such con~rac~ shall provide that: <br /> <br />ao the underwriting merchantile establishments shall <br />reimburse the city for the initial cost of providing <br />time-s~amp machines, shelter for attendants, signs~ etc., <br />in an amount not ~o exceed $300.00. <br /> <br />h. the underwriting merchantile establishments shall <br />reimburse the city for the salaries of attendants and <br />accountin~ costs in the amount Of $300.00 per month, <br />less the total amount collected by the city in that <br />month because of the five cents per ho~r service charge <br />provided for in Section 30-177; provided, that in any <br />contract year in which the grosS revenues of said lot <br />e~eed the sum of $11,375.00, t~e amount of such excess <br />g ss revenues shall he credite~ against the monthly pay- <br /> <br />c~ the underwriting merchantile establishments shall be <br />entitled to validate tickets for a period of one or more <br />hours of parkir~ by stamping on the tickets a legend <br />showing the name of the establishment and the number of <br />hours for which the tickets are validated, and settlement <br /> <br /> <br />
