AN OEDI~%NCE TO AMEND AND REORDAIN SECTION 20 OF THE '~ORDI~%NCE <br />TO PROVIDE A SUP~TAL RETIR~NT SYSTE~ FOR CITY ES~PLOYEES", <br />ADOPTED AUGUST 25, 1953, AS A~ElfDED, IN ORDER TG PROVIDE CONTINUED <br />~BER~IP FOR LIMITED PURPOSES FOR CERTAIN ENS~LOYEES TRkNSFERRED <br />TO T~TE OFFICES OF THECONNISSIONE~ OF THE REVEMUE AND THE CITY <br /> <br /> Be it ordained by the Council Of the City of Portsmouth, Virginia, tha~ <br />Section 20 of the "Ordinance to Provide'a Supplemental Retirement System for <br />City Employees", adopted August 25, 1953, as amended, be amended and reordained <br />to read as follows: <br /> <br /> Section 20~ CESSATION OF N~SERSHIP. The membership of any person in <br />the system shall cease: <br /> (a) 1f he ceases to be an employee, unless the member leaves service <br />after twenty or more years of creditable service and has attained age fif~, and <br />does notwithdraw his accumulated c.ontribu~ions, or <br /> (b) in any event upon the withdrawal, of his accu~ulated contributions~ or <br /> (c) upon death. <br /> <br /> 'Anything ~o the contrary herein notwithstanding, the membership of any <br />person shall not cease by virtue of the f~ct that he became eligible for member- <br />ship in the Virgini~ Retirement System upon employment by or transfer~o the <br />.offices of the commissioner of the Revenue or the City Treasurer upon or within <br />'s~xty days of July 1, I959. The-membership~o~ any such person shall e~e <br />his emDloyment in the offices of the Commissioner of the Revenue or the City <br />Treasurer thereafter termin~tes for any reason other th~ul death, retirement or <br />resignation to accept immediate employment with the City in a position covered <br />by the Drovisions cT thi~ ordinance. Service in said o~ficeS by a~Y such person <br />shall be considered as creditable service under this ordinance when determining <br />eligibility for ordinary disability re.tirement, service connected disability re- <br />tirement, and additional death benefits under Sections 38nnd 39 hereof, but such <br />service shall not beconsidered as creditable service when computing allowances <br />under this ordinance. <br /> <br /> This ordinance being necessary for the preservation Of the public health~ <br />morals and safety, an emergency is declZred ~o exist and it shall be in force <br />and effect from and after its p~ssage. <br /> <br /> <br />
