AN ORDINANCE TO AMEND SECTIONS 24-26, 24-27, 24-34~ 24-35, 24-44 <br />AND 24-45, AS AMENDED. OF CHAPTER 24 OF THE CODE OF THE CITY OF <br />PORTSmOUTh, VIRGINIA, 1951, PERTAINING TO THE PORTSMOUTH WATER <br />DEPARTM~{T, SERVICE CONTRACTS THEREWITH, AND ITS BILLING AND <br />COLLECTION PROCEDURES. <br /> <br />Be it ordained by the Council of the City of Portsmouth, Virginia° <br /> <br />Section 1: That Sections 24-26~ 24-27, 24-34, 24-35, 24-44 and 24-45, as amended, <br /> <br />of Chapter 24 of the Code of the City of Portsmouth, Virginia, t951, be amended and <br /> <br />re-ordained, to read as follows. <br /> <br />Sec° 24-26~ Execution of contract as prerequisite to water service; owner's liability <br /> for water furnished tenant. <br /> <br /> The o%mer of any premises desiring water ~o b~ supplied to such premises <br />shall be required to sign a contract upon a printed form prepared for the purpose in <br />the office of the water department containing the provisions and in the form as set <br />forth in section 24-34 or in section 24-35 of this chapter. A separate contract shall <br />be required for each premises as defined in section 24-42 of this chapter. However, <br />an owner shall not be required to pay for water furnished to a tenant, where the owner <br />does not also reside on the premises served by such meter, for more than four month's <br />water bill. <br /> <br />Sec, 24-27. %%~en cash ueposit required as prerequisite to service° <br /> <br /> ~enever the owner of a premises refuses ~o sign the contract mentioned ~n <br />the preceding section or repudiates or cancels a contract previously signed by him~ <br />no water shall be supplied at the premises until the owner or tenant applying for the <br />water shall deposit with the superintendent of the water department a cash deposit equal <br />in amount to the average bill for the premises~ including charges for sewage disposal <br />service and utility taxes based thereon, if any, for four months if it be a quarterly <br />account~ or 5wo months if it be a monthly account; provided, however, the deposit shall <br />not in any case be less than ten dollars.
