thereafter collected with respecz to the tax on public utility services as thereto- <br />fore effective, shall be transferred and paid over forthwith into a separate £und <br />known as the General Capital Improvement Fund, to be applied as appropriated from <br />time to time by Council to the cost of constructing or purchasing general capital <br />improvements; provided, however, that priority of expenditure to the extent funds <br />are availmble in any one year shall be as follows: <br /> <br />(a) first, the amount necessary for debt service on and retire- <br /> ment of outstanding bond issues pertaining to school construction; <br /> <br />(b) second, the amo%mt of two hundred fifty thousand ($250~000.00) <br /> dollars for construction of curbs, gutters, and storm drains; and <br /> <br /> (c) third, all other general capital improvemenzs~ <br /> Section 2: This ordinance being necessary for the preservation of the pub- <br />lic health, morals and safety, an emergency is declared to exist and it shall take <br />effect from its passage; however, the application of the tax levied and imposed by <br />this ordinance is subject to the following provlsions: on all charges for local ex- <br />change telephone service, electricity service and gas service appearing on bills dated <br />prior to J~_ue 1, 1959, and on all charges for water servlce appearing on bills dated <br />prior to July l, 1959, the tax shall be computed in accordance with the provismons <br />of Sections 8-53 to 8-62, inclusive, of the Code of the City of Portsmouth, 1951, <br />prior to amendment thereof by this ordinance; on all charges for local exchange tele- <br />phone service, electricity service and gas service on hills dated om or after June 1, <br />t959, and on all charges for water service appearing on bills dated on or after <br />July 1, 1959, the tax shall be as provided in this ordinance° <br /> Section S: If any part of this ordinance shall be for any reason adjudged <br /> invalid, such invalidity shall no~ affect the Darts which are not adjudged invalid. <br /> <br />Adopted by the Council on MAy 26, 1959. <br /> <br />True Copy <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
