<br /> Be it ordained by the Council of the City of 'Portsmouth~ Virginia, that
<br />Chapter 17 of the Cod~of the City of Portsmouth, Virginia, 1~51, be amended by
<br />adding thereto a new s~ction numbered Section i?-~4.1~ to read as follows:
<br />
<br />Section 17-~4ol. ~inors - Curfew.
<br />
<br /> (t) It shall be unlawful for any parent, guardian or other adult person
<br /> having the care a_nd custody of any minor under seventeen years of age to kn~vin~ly
<br /> permit~ allow ~r e~courage such minor to he and remain in and upon any street, avenus~
<br /> road, alley~ park, ~_cant lot, playground,.Wharf, dock, place of amusement, or in
<br /> and upon any other public place, whether of like kind or not, in the city between
<br /> the hours of lt~:00 p.~. and 5:00 ACM., of'~the fo~towin~ day ~n!ess such minor is
<br /> accompanied by such parent, guardian or other adult person having the care and cus-
<br /> tod~ of such minor~ or is on an emergency errand ~r legitimate business and has a
<br /> w~i~ten statement ~o ~hat effect signed by such parent, ~aardian or other adult perm
<br />~s6n Wing the care and custody of such minor°
<br />
<br /> (2) It shall be unlawful for any ~tnor under the age of seventeen years
<br />to be and remain in and upon any street, avenue, road, alley, park,~vacant lot~ play-
<br />grou_ud~ wharf, dock~ place of ~semen~, or in and upon any o{her public place,
<br />whether of like kind or not, in the city Between the hours of ll:O0 P.~o and 5:00 AoNo,
<br />ol the following ~ay unless such minor is accompanied hy his parent, guardian or
<br />other adult person.~having the care and custody of such minor, or is on an emergency
<br />~rra~d or legitimate ~sinsss and has a written statemen~ to that effect signed by
<br />his ~aren=, ~ardian or other adult person having the care and custody of such minor.
<br />
<br /> (3) Whenever any police or other officer charged .with the duty of enforc-
<br />zm~ the laws of this state or the ordinances of this city shall discover or have his
<br />attention called ~o the fact that any minor uader the age of seventeen years is in or
<br />on any s~ree~, avenue, road, altey~ park, vacant lot, playground, wharf, dock, place
<br />of amusement~ or is in or upon any other public place, whether of like kind or no~,
<br />between the hours of 1t~00 P.N. and 5:00 A.M., of the following day, the officer
<br />shall make an i~ediate investigation for the purpose of ascertaining whether or no~
<br />the presence of such minor is in violation of any of the~ nrovision~ of this section.
<br />~f such investigation ~eveals that such presence of such minor is in violation of any
<br />o~ the~ pro¥~ions of this section, then the officer shall take the name and address
<br />of' sHh~~ ~i~o~ and the name ~ud address of the parent, guardian or other person having
<br />the care and custc~ of such m~nor, and shall issue,'a summons or o~herwise notify such
<br />minor ~nd such par&n~, guardian or other person having the care and custody of such
<br />minor, in writing, to appear before the judge of the .~avenile ~ud domestic relations
<br />court.of the city at a time ~o be specified in such summons or notice, to be there
<br />dealt with according to the provisions of this section and the laws of the State
<br />applicable there~o~ The officer shall also order such minor to forthwith proceed
<br />
