&N ORDINANCE TO AMEND SECTION 30-86 OF THE CODE OF THE CITY OF <br />pORTSMOUTH, VIRGINIA, 1951, AS AMENDED. CONCEPd~ING PROCEDL~E <br />VEHICLE FOUND ILLEGALLY PARKED. <br /> <br /> Be it ordained by the Council of the City of Portsmouth~ <br />Section 30-86 of the Code of the City of Portsmouth Virginia, <br />be amended and reordained Lo read as follows: <br /> <br />Virginia, that <br />1951 as amended~ <br /> <br />Section 30-86. Procedure when vehicle found illegally parkee: officers~ <br /> eLc,, not Lo !nterfere with imposition of pemalties. <br /> <br /> Except where otherwise provided it shall be the duty of each police <br />officer of the City Lo give zo the person operating a motor vehicle illegally <br />parked~ a notice or to attach Lo the vehicle found so parked, a notice ~o the <br />owner that such vehicle has been illegally parked and instructi~I him to report <br />to the clerk of the 5~nicipal Court Traffic Division. Each person so notified <br />may within seventy-two hours from the ~lme when such notice was given or attached <br />to the vehicle~ pay Lo said clerk the sum of three dollars for each hour or frac- <br />tion thereof, iuring which such vehicle was illegally parked. If tee owner o~ <br />such vehicle fails to make such payment to the said clerk within seven~y-Lwo <br />hours of the time such notice was attached Lo such vehicle~ then an additional <br />notice shall be given to such o%~]er and au additional penalty of one dollar <br />shall be charged for said additional notice. <br /> <br /> The failure of such o%~mer to pay to the said clerk the penalty for the <br />vlolatlon and the one dollar for the additional notice within eight days [rom <br />the date of violation shall render such o%~er subject ~o the [enalties provided <br />in Section 30-23. <br /> <br /> It shall be unlawful for any police officer~ city official or any othcr <br />person to remove from the repor~ or destroy the record vf the illegal parking <br />of any vehicle, or ~o do any other act which shal] prevent the penalties from <br />being lmposed~ <br /> <br /> The provmsions of this section shall not preven~ the enforcement of the <br />yrovislons of Section 2-71~2 concerning the removal~ impounding~ etc. oi mosor <br />vehicles, under certain conditions <br /> <br /> Adopted by the Council of the City of Portsmouth az a meeting held on <br />September 13~ 1960 <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
